Speaking of Gaga weird, that picture in the first post of Will Smith and family staring all agog was taken during Gaga's performance and not Miley's. You can tell if you look carefully - it looks like they were just given a shit sandwich with prosciutto served on a guten-free baguette by a coquettish boy wearing nothing but a hat made of meat and a Thomas the Tank Engine codpiece. If it had been snapped during the Miley Cyrus performance, they would have looked like they were just served a shit sandwich with PB&J on wonderbread.

As far as the controversy goes, while I hate using the word 'meh' that pretty much summed it up
She's suprisingly unattractive, a shitty dancer, and is trying waaaay too hard. Watching her performance was probably the least arousing thing I did all night. It was like watching a 13-year old girl with a terrible buzz cut with no conception of what 'erotic' or 'sexy' is. And I'm fairly easy to arouse. I still think Britney Spears's VMA performance where she stripped was one of the sexiest things I've seen on TV. And I even think Miley used to be decent looking before she started trying waay too hard and got the world's worst haircut. But that was godawful and not worth a fraction of the media attention it's unfortunately getting. If shoving a foam finger into someone's covered crotch and sticking your tongue out is considered 'x-rated' then I don't even know what to say

It is known as sampling perfectly legal so long as you don't go too far which I don't believe they did.


A well known case in this area of the law at least in the U.S. is Campbell v. Acuff-Rose Music, 510 U.S. 569 (1994) - otherwise known as the "Pretty Woman" case although that case was specifically about parody rather than straight sampling.

Re David Bowie. "Ice, ice, baby" was a blatant PoS rip-off of one of the best songs of the early '80's. Everyone who heard that riff and had a scant idea of rock music history made the connection.

And I doubt that VI - at that time at the peak of his transitory success - would have caved unless he had no case. At the time, he was outselling Bowie and the music industry would have tried to protect their gravy train.

Actually Van Winkle had no case.

After he sobered up Bowie became a venture capitalist, he backed Bill Gates when he was getting MS-DOS of the ground. Van Winkle nearly got away with it but hubris got the better of him. He trashed the terminally ill and that was all she wrote for Bowie.

If the Gaye estate had a dollar for every time a songwriter used Marvin's music they would be multimillionaires. Thicke is a scumbag for using his music without consent but how can you not like the video.
