A source confirmed that 2DayFM’s lawyers had listened to audio of the entire call prior to broadcast and had given it clearance to go to air.

Mr Holleran (the chief executive of Southern Cross Austereo, which owns the station) said it was ‘a bit early’ to be drawing conclusions (about the suicide) from what was really a ‘deeply tragic matter.’

He added: ‘I don’t think anyone could have reasonably foreseen that this was going to be a result.'

He seems to be trying to put the 'A reasonable person would not have reacted this way to being punked' defense out there as I suppose he will do in any for future civil action
I wonder how many cyber bully defence attorneys use the same point.

As mentioned in #82, the question I'm sure that was actually asked was: will airing this violate a provision of the Australian broadcasting code, will airing this directly violate the provisions of the "probation" the ACMA has us on. I am sure they were not asked: Is this a violation of English Criminal Law, will airing this open us up to a possible civil lawsuit, is this appropriate and/or moral behaviour.

You are likely correct that they are floating potential defences.

The key problem with your logic is that she didn't die while the "fraud" was being committed.
Second - technically pretending to be the queen and old dog charles was fraud but the impersonation was so friging crappy that only a dumb ass would believe it. Did you even hear it?

May that woman rest in peace but I will not sit idly by while harmless jokers are blamed for it.
There is zero connection between her death and the joke

There is much more connection to her death and the attitudes of bullies in her workplace. There's even more motive for the royals to axe her than there is between the prank and her apparent suicid

f she was that mentally unstable what is she doing at work?
The hospital has a larger part in this than is being recognized.
There were bullies in her workplace? The Royals did it? Do you have tin foil curtains in your room?

However, you are conflating two separate possible criminal acts. There is fraud and possibly other crimes related to the telephone call. Then there is the much harder to make case of manslaughter or harassment regarding the death of the nurse.

We might say why didn't they suspect something but it is a sad commentary about life when instead of concentrating on how concerned they were about the Duchess and how at five o'clock in the morning respectful they were, the thrust from many instead seems to be a version of caveat emptor on those receiving prank calls rather on those who make them.

The Hospital certainly seems to feel (and I presume they know) that both nurses took this hard - feeling that the radio station played them for fools.

Surprisingly, as we are on Terb, nobody has mentioned the obvious, namely that the female radio hostess is way hotter than Kate.

this whole incident seems fishy... I'm thinking she got murdered. I mean.. everyone she knew, from nurses to driving instructor, says it was unlike her to commit suicide. I'd think a nurse would be sane enough to handle all the stress that comes with dealing with patients everyday. Could it be another disappointed husband who tried to get rid of her?

speculations.. speculations.

i mean.. these Indian/South Asian husbands think they're still in Asia and have different outlook on wives. Even in Canada, we have almost one or two incidents each year, where the husband kills off the wife because she became to Westernized etc. Not far off.. i mean, was she really that distraught over a simple prank call, one which even the Royals or the Hospital didn't discipline her for, that she thought it was best to take her own life and leave her two kids behind? I sure hope I don't get taken care of by such a nurse who doesn't even have her priorities straight.

It would appear she was. As for the conspiracy nutters among us, feel free to waste your time. Have you ever talked ot any one who has tried suicide, or had someone in your family who has done so? Somehow I doubt it, or you would not say such things. I know there a re a couple and they are surprisingly silent.

yes i have.. there are always signs that something is amiss in their life regardless of how happy or normal they may seem. Only fools like you would miss signs because you're too busy worrying about your own life

'Amiss' is a very vague word. I've not met many people who didn't have something 'amiss' in their life.

The majority of suicide are not done by people who are mental ill, just desperate to end their problems, killing themselves is not the default setting. We all feel depressed on occasions, just not that depressed or for that long a period of time. Very few who try, ever try again or succeed at a later date.

For the love of God, talk about a grade B movie plot rather than the real world.

How about this instead: The nurse liked her work, and took pride in it. Perhaps she had met the Duchess and found her to be kind and considerate. This occurred at 5:30 in the morning (see my previous comment in #26 about working all night). Perhaps like most in the U.K. she supports the monarchy. Perhaps she felt that she had let down herself, the hospital, the Duchess and the Royal Family. She was in an emotionally vulnerable place (many are at Christmas).

Further ask yourself who put her in that place what was the proximate cause - the answer is the phone call of the two idiot Australian DJs.

I forget quite where I read it (perhaps in this thread), but it struck me as true: Sane people are not completely sane 100 percent of the time, likewise the insane have periods of lucidity.

Simply put, suicide is complex.

I believe that. I always found you pretty sane except for this royalty thing, the mere mention of which makes you insane.
