Not really. IF he had kept beating up the man after he was incapable of resisting that would be an entirely different thing. However, that is not what happened he struck him several times in the head until he stopped resisting, he even called an ambulance saying "This guy was raping my daughter and I beat him up. And I don’t know … I don’t know what to do.. . . .[they need to hurry up] The guy’s dying on me!”

- That as the Grand Jury found isn't murder (particularly as Texas law allows for the use of deadly force in defending against rape).

Given that the rapist died before an ambulance got there, do you think he might have succeeded in raping the girl by the time the Sheriff's Department arrived?

Further, since the use of deadly force in authorized in Texas in protecting yourself or another from rape. . . . .

At what point does intervention, or stopping the crime in progress end and retribution or vengeance, albeit under emotional distress, begin?

I am going by the link I posted where it seems to suggest that they guy was pulled off the girl and then a beating ensued. It wasn't as if, unless there are better sources, the father started pounding him while the attack was taking place, or beat him in the head with a sledge hammer from behind while the 'rape' was taking place.

While it may not be murder in Texas but is there not a lesser charge that may be applied?

Go back to post #6. Basically at the point where "bad guy" is incapable of resisting. e.g. you shoot “bad guy” he is screaming in pain and both arms are out of commission. Now you find that not only was he attempting to rape the girl but he had beaten to death the baby sitter so you go back and finish him off.

Self-defence stopped at the end of the first paragraph, the action of the second paragraph although one might argue retribution will get you charged with murder (although you might argue the jury should reduce it to manslaughter).

I would say once the criminal is unable to continue committing the crime and the situation is under control does retribution and vengeance begin. As I mentioned here, from what I read in the story, I will give the father the benefit of the doubt. It sets an example to 'would-be evil-doers' that they can't hide behind the law.

You are correct that we do not have a grand jury system. But the eventual outcome would likely have been the same.
