Killing the kid was not called for.

He could have just shot in the air and it would have scared the shit out of them.

He's guilty of manslaughter.
The 65 year old will get his day in court, he was defending himself from teenage punks. Ever see "Gran Torino" with Clint Eastwood?

If the kids just knocked him off his bike then I agree, manslaughter.

But if they then proceeded to assault him, I think he had the right to defend himself and if that meant killing one of the assailants (kid or not), so be it.

Seems that the teens knocked the 65 year old man to the ground and then assaulted him while he was on the ground. This would be seen as a life or death situation for the 65 year old man.

Not everybody is 6'6" like you who could fight off 3 teens with one arm tied behind your back. But, you are right self-defense is illegal in North America and the old man will probably spend the rest of his life in jail. Look what happened to Bernard Goetz(sp).
Goetz was found not guilty of all charges laid against him except for possession of an unlicensed firearm. Also, if my memory serves me correctly (not always the case), the individuals who approached Goetz, while threatening, did not strike or attack him (I'm not saying that they would not have done so if he had not acted) but demanded that he give the money.

The wealthy people who make the laws do not have to worry about situations that people whom they have decreed these laws upon have to. That is because the circles they travel in are safe and civilized. :D cheers to the old man!!!think of how many lives he has saved when punks like these ones think twice next time. Life lived in fear is not worth living.

If you're going to pass judgement based on two sentences from a third party...

But I'd leave it to the courts to decide based on the real facts. Anything else is just uninformed opinion (including my own above).

Per Wikipedia "he served two-thirds of a one-year sentence", the charge being illegal weapon possession. Goetz was acquitted of all other charges.

Penn passed "no retreat" self defense laws similar to Florida's last summer. This guy is probably walking scott free.
Years ago the Supreme court of the US, made a ruling that people no longer had to retreat, they could stand their ground and fight back. In Canada you are required to attempt to retreat until you can no longer do so.

The man was released by police after they consulted with District Attorney John Adams late Wednesday, WFMZ reported.

I do not believe that is an accurate reflection of US law. Got a link to the case?

And if it was an accurate reflection why did Florida and Penn (and I think 13 other states) have to recently pass legislation to say that?

This story has me waffling between two very different stances.
On one hand, I'm kind of cheering for the old fellow for standing his ground and showing the punks that they can't just pick on people like that, especially older folks. Chalk up one for the underdog.
Then, on the other hand, it makes me question the US's position on the right to bear arms. In this case, it seems that some judgement was used and the older guy was possibly justified in doing what he did, but had that gun been in the hands of someone else, the situation may be very different. Who knows who could be dead and for what reason.

The circumstances are a little different (no knife, but three assailants), but Brown vs. United States 1921 (256 U.S. 335 285) covers what I was speaking of.

Why should the old man have to wait for the punks to beat him more before he stops them? And why should he have to fire a warning shot? What does he owe two violent criminals?
Isn't that the Canadian way? The retaliation has to fit the crime!

He probably had six bullets and only took out one attacker, injuring a second TOTALLY not shooting a third assailant. A real softy. I'll bet the boys at the shooting range are gonna rib him about that.
