Except for a few RED States in the USA like Georgia perhaps which seems about as farked up as Italy!...In Canada, the U.S. or any Common Law Country this case would never have gotten off the ground.

You can not discipline a Crown in Ontario. In Canada, the U.S. or any Common Law Country this case would never have gotten off the ground.
As for the prosecution knowing that their most important evidence had been throughly discredited continuing to argue for a conviction, in most juristictions in North America this could and likely would lead to Bar discipline.
I think the story is that the prosecutor didn't like the way she answered questions so he condemned her for it (literally). In this case the chief prosecutor had just recently been charged with "abuse of office" pertaining to a failed investigation into another one of his "hunches". So most feel that he was hoping to redeem himself with the Knox case. When the supposed "motives" that he claimed were behind the killing fell apart, he just fabricated new ones. It started with a ritualistic sex orgy gone wrong, but when one of the "accused" (in the alleged orgy) had an airtight alibi, he decided it was a fight gone wrong between Knox and Kercher over Knox's hygiene (wtf?!), then it became Knox was caught stealing money, and then in the end the prosecution claimed Kercher was killed for no reason at all.Honestly the Italian justice system must be truly warped. After they had Guede why did they feel it necessary to go after Knox and her boyfriend? Were the prosecutors trying to make a name for themselves? I don't get it.
Which is not uncontroversial. You can not discipline a Crown in Ontario.
Exactly. What I was posting of was deliberately proceeding when you know that your evidence is worthless, not a "you shouldn't have been so mean."Well, you can discipline a Crown in Ontario, but not for being a fuck-up. It's a cost benefit thing. If a prosecutor could be investigated and disciplined for every real or imagined error of judgment he / she made, our prosecutors would be spending 99% of their time defending themselves from complaints, the majority of which would undoubtedly be garbage.
But if a Crown screwed up here like those Italian prosecutors, they would have a shit-storm to deal with informally behind closed doors in their supervisor's office. not all "discipline" officially goes on one's record.
Yeah, blame the brother and let the little white girl go...I mean heck.. They already HAVE the murderer behind bars (Rudy Guede)..
Oagre, I admit to knowing no more that what has been reported in the popular press. But when two of the leading experts in Italy on DNA typing, appointed as independent experts by the court, say that your crime evidence procedures were a disgrace as was were your DNA procedures, and that they can't duplicate any of your results. And instead of asking for a recess and considering whether to withdraw charges, instead you attempt to attack the credibility of the Court's own experts and ask to increase the sentences. That sounds well over the line to me.If he KNEW his evidence was worthless, that suggests it should be an ethical complaint to the Society for malpractice as a lawyer. That is different from abuse of Crown discretion.
Each of us is entitled to an opinion even the Italian Chief Judge said today that she may known what happened, or may have been involved.Nancy Grace say's Amanda Knox is guilty.Stay tuned.
Nancy Grace has never said anyone is innocent, AFAIK. Hmmm... would that be because her show is pitched to moronic hick bottom-feeders who believe everyone is guilty of something and that it's fun to see folks humiliated and sent to jail?Nancy Grace say's Amanda Knox is guilty.Stay tuned.
i would like to see nancy grace sued for libelNancy Grace say's Amanda Knox is guilty.Stay tuned.
