LOL.... wow, the streets of TO would be so much easier to navigate if ALL the cell phone/drivers were tossed in the clink. I think most streets would be baren in TO if that was the law. The air would be cleaner too and all the cyclists and Miller would be in their glory. Fat chance of that happening. LOL

Hello, IT is the law!What is so hard to understand?Do not talk on cells while driving.So simple.Remember a longgggggg longggggg time ago when cells didn't exist?People made it to their destination without gabbing on a phone.I call that heaven,no one bugging you while you drive along listening to your fav tunes.I really think people have gone nuts,hm,maybe from the cell phones effect,some psychological backlash.

The Highway Traffic Act Ontario Regulation 366/09 states the following : Section 9 Exemption for law enforcement officer 9. The following persons, while engaged in the performance of their duties, may drive a motor vehicle on a highway while holding or using a hand-held wireless communication device: 5. Persons appointed under a statute of the Parliament of Canada and who are peace officers within the meaning of section 2 of the Criminal Code (Canada). Under the definition of Section 2 of the Criminal Code, a Mayor is a peace officer.

That's a big "If…". Frankly I don't see how my Mayor—be it Rob, Miller, Mad Mel or whomever—can drive himself and perform the duties of Mayor simultaneously. Let alone talk on a cell phone while doing either. Both jobs demand full attention.

And the exemption granted by the law doesn't make it any smarter or safer. The only excuse would be some overriding emergency requiring such foolhardiness from the Chief Executive, like a massive propane explosion.

The Bird, I'd expect from him.

The mayor was in the proper execution of his duties acting completely properly as a Peace Officer - The Mayor!!!

Therefore..if some obnoxious lady was interfering with his duties...in a rude way..SHE deserved the Bird...Hell..she is lucky SHE did not get arrested for OBSTRUCTING A PEACE OFFICER........even though he denies giving her the Bird.

The Mayor is correct in this situation. The naysayers just like to stir the pot - to the humour of Robby I am sure!! :)

Actually he's right, and I was surprised. The definition of "peace officer" given in the criminal code explicitly lists "a mayor" as one of the officials included in the definition. So he's right, if Rob Ford could be construed as using the device while performing his duties he is in fact exempt.

That doesn't excuse flipping the bird, which was always the more offensive part of this story, and it doesn't make his behavior any smarter, or any safer, but it does get him off the traffic ticket.

It's still obnoxious behavior, just not illegal obnoxious behavior--like his drunk driving.

Regardless. Rob Ford has not declared the cost of his cell phone in his public accounting; one of many expenses that seem incorrectly documented and are currently the subject of an audit. His lame defence is that he does not use a cell phone as mayor and thus need not declare his personal phone.

Very well. If it's his personal phone, it was not official business and he is not exempt.
