He fired the 33 year old after she worked for him for 10 years without any flirtatious behavior and stellar performance of her job based on a decision he reached with his wife. Apparently the wife found some texts being exchanged and hauled hubby off to see the pastor. I wonder if the all male panel of judges were influenced by their (unattractive) wives to uphold the decision. It seems this guy is a dirty dog who cannot be trusted not to have his pants bulge. Horrible decision, imo.

Her physical appearance was totally irrelevant to her job.

If I go to Hooters, I expect my waitress to be hot.

If I go to see my accountant, I could care less what he/she looks like.

The only smelly part here is, his reason went public.

In Ontario, she may have gotten double the severance.

This looks like the case of a jealous wife and her wrath but hubby did get too close. Isn't telling your secretary that if you see a boner through my pants because of your tight clothes, sexual harassment?

I always find it amusing when people don't realize you can be terminated from your job (assuming it's non-union) for ANY REASON WHATSOEVER. In short, you have ZERO entitlement to your employment.

Now if you're terminated based on one of the prohibited grounds of discrimination, or if you're terminated in a particularly humiliating fashion, you can sue for damages but at the end of the day you have no entitlement to the job.

So if a dentist wants to terminate his assistant because he finds her too tempting, he's perfectly within his rights to do so provided he gives the proper notice (or pay-in-lieu of notice) and pays severance if the employee meets the eligibility criteria.

Word has it the girl who got fired constantly complained to the dentist about the lack of her sex life.

That probably played a large role in why she lost her case.

The guy should have let his wife working with him in the office so that she can 'keep' her eyes on him! Most dental offices I have come across from here the wives are in the office working in some type of capicity. I have changed dentist three times in the past few years and all of my dentists have wives working for them!

If I were the judge, I would look him in the eye and asked - 'If there was no urge for you to have sex with this woman - could she work for you ? '

If he said 'Yes', I would have him taken from court and castrated. Pussy whipped little shits like this one probably wouldn't miss them anyways.

It depends on the jurisdiction, each province and state having its own laws, and it depends on the terms of the employment contract (the collective agreement in the case of a union employee or your individual contract of employment in the case of a non-unionized employee).
