The Fifth District Court of The Florida Court of Appeal ruled today (Wednesday) that the Trial Judge (Judge Lester) should disqualify himself from the case.

Now this always may prove a move from the frying pan to the fire, but it looks like a break for the defence.

Too bad the evaluation isn't, "This should make proceedings more impartial and a fair and proper result more assured."

Why should the judge 'disqualify himself'?

What did he do?
The Defence asked for him to be removed for bias, after comments made about how George Zimmerman was untrustworthy at the second Bail Hearing. They seemed to be pretty intemperate remarks for a judge who expected to preside over the trial.

Although phrased as a request from the Court of Appeals, it isn't it is an order.

i remember seeing videos of AL SHARPTON while active as a host on MSNBC walking arm in arm with other community activists to promote this case and push for this trial and then using his TV show to relentlessly (and in my shamelessly) push his agenda ............. the bias and racial politics in this trial are staggering. And we can all connect the dots between the affiliations of those front and centre on this

She's always rude to the defense lawyer Don West and very pleasant to the prosecution, today she was having it out with him because she wanted to know if Zimmerman wanted to take the stand, and the lawyer tried to say something and she was rude....

If the judge does step aside, and given the weaknesses of the prosecution's case and the strengths shown in the defense case, I wonder what the likelihood is that the prosecution simply declines to re-try the case.

I can't imagine the prosecution finding a way to present a significantly stronger case (they could avoid certain mis-steps which the defense correctly capitalized on), and the defense would still have a very strong case in its forensic experts and the original investigating officers.

If the judge and prosecutor are both elected, it sorta 'splains their various mis-steps along the way. It's very hard to make the same decisions about what should be done in the court of public opinion and in the court of justice. They have thousands of 'clients' to please and what those clients want varies all over the map; the defence attorney has just one and what he wants is clear.
