Hello, would appreciate your opinion on this. I’m recently married and I’m sponsoring my wife who is from overseas. In the visa application it asks her to get a police report from her home country. Problem is - she has had a charge for being a sex worker there. No criminal charges were laid because she was a first time offender. We don’t know if this will appear on her police report. I told her I don’t think it’s a big deal, and I don’t think the Canadian immigration will either. It’s not murder, or drug trafficking. I would appreciate your thoughts on this one fellas.

Brother you sure about this???

Call Law society of Canada for immigration lawyer, you get 30 minutes of free consultation. Make it seem like you want his services and after few minutes of how it be better to go with him, pop the question.

Also, there are countries most European ones, that have a full automatic Pardon after 3 years. If thats the case no worries.

You could also call immigration as Mr. Smith from a burner phone.

seek an immigration lawyer...but...Canadian Immigration isn't lenient to foreigners with criminal record regardless of what it is...on top of that...there are also requirements when you married someone from another country. You will need to provide proof of communication for at least 5 years (letters, emails, phone records etc etc) That you were indeed in a relationship with this person long enough...

Why don't you get the police report and see what it says, might be a start.

You need to get the record. Get it. Then deal with it.
Doesn’t make sense, you said she has a charge then you say no criminal charges were laid.
We can’t guess or advise what is on the record.

I wonder what's she doing to pass the time until she arrives from overseas? :D

Gentlemen, please do cease and desist from the 'gloom & doom' scenarios. Who is anyone to judge?

OSC has made an inquiry into a very important issue and deserves educated and informed answers.

He has chosen a partner to go through life with and I wish him nothing but the best.

Paradise by the dashboard light.
would probably depend on how she was processed when charged, if it was entered in THE system and how one would answer THE question verbally, if asked

I am not a lawyer but I know that there are immigration lawyers in the GTA who will give free consultations which might be more useful than asking for opinions on this forum. Perhaps because she has no criminal record and no criminal charges were laid so that she is not waiting disposition or sentencing then there is nothing to worry about. The police record would have occurrences that have not been proven in court. I would think that Canadian Immigration is interested in applicants criminal records only. If you new wife has already been able to enter Canada without any problems detected on her passport then this is a good sign. I wish you the best of luck with your new marriage.

It might be a good idea if you enabled PM's because I am 100% done with participating in public threads in the Lounge and other non review pages of this site.

If you PM me, I will give you the legal answer.

It’s what my common sense tells me as well. The SP and massage industry has become rampant from police wanting to catch the big fish and the government choosing to pursue something more pressing. You make a good point about her being able to enter without any issues, so perhaps it’s a sign of what’s to come. Thank you for your wit, I never considered that.
