Robert Baltovich would not be the first person wrongly convicted of murder. Canada has a terrible record of convicting innocent people. Steven Truscott, Donald Marshall, David Milgaard, Jean Paul Morin, etc., etc. Thank goodness, we don't have the death penalty. (Even with Paul Bernardo, they didn't find the video tapes when they searched his house.)

Thats why they cut a deal with his girlfriend, then afterwards when they had the tapes, the Crown knew they made a mistake cutting her some slack but she is a free women now-so at least they kept their end of the deal.

Sure in some states in the USA, she would have been "killed by another inmate" while in prison :rolleyes:

But in Canada it seems like the ones who do go to jail for a crime they did not do, can never sue and get millions of $$$ like in the USA, so thats not too cool.

Either way, it still really stink to be locked up for something you never did ! Dam, talk about a "bum deal", lol

Mention the death penalty in the same thread that a wrongful conviction is being discussed??? and he is just one--Morin, Truscott, Marshall..long list...if you need a better reason NOT to have the death penalty, then I don't now what it could be....

And Guy Paul Morin. I am not so sure that Truscott was innocent either. And Marshall admitted that he was in the park to rob people, so jailing him is ok with me. But you are right, there are innocent people jailed, which is a pretty good argument against the death penalty.

I believe Truscott requested DNA comparisons be done on himself and the semen stained panties that were used as evidence against him at his trial. Of course DNA technology was not available at the time of his trial. Unfortunately the panties had been lost and the testing couldn't be done. But my point is guilty people usually don't ask for DNA testing. Do they? would you?

Marshall was convicted on pergered testimony from one of his friends, truscot was convicted because he was the last one seen with the girl, morin as well.

Truscot was sentenced to hang but had his sentence commutted.

The death penalty is a final option for some people it is the correct solution, Bernardo and olsen come to mind . There is no doubt regarding their guilt and quite honestly I don,t see a reason for their continued breathing, my opinion in that case.

That said because it is the final option it should only be used in cases where there is no doubt regarding guilt, eye witness testimony is not enough to bring a penalty of death it is to unreliable

So you would then have a guilty verdict and and REALLY guility verdict...so for those we are pretty sure did it--get one level of guilt, others (you would use Bernado and Olsen I guess) we would have a even higher surety of guilt...sorry but officials were REALLY convinced on some these cases that have been overturned

sorry but there is a line--reasonable doubt and guilt is established beyond that

it does boggle the mind when you look at some the cases overturned what passes for enough evidence...esp "down there" read Grisham's latest book...anyone that reads that and still believes in death penalty would be hard to fathom...

the death penalty is a tool used properly is an effective tool. The problem is the used properly part. In the states it is used as a method of prying admissions out of people, that is an incorrect use.

The death penalty should be reseved for people who kill cops and multiple murderers, the level of proof should be set very high .

The reason for not makeing the death penalty available when certain kinds of proof are offered is that certain kinds of proof can be influenced by whoever is offering the proof. In Bernardo's case I would not have allowed the death penalty to be used on Holmolkas testimony, to easy to influence. The video tapes on the other hand would get him hanged.

..and still no tknowing all the evidence...

I am still not convinced that BALTOVICH is not the guy!

There was insufficient evidence to PROSECUTE..perhaps?

But to say he is CLEAR.....I am not convinced.

Lots of people get away with crimes because not enough evidence.....that does not CLEAR someone...only in the courts.

Perhaps a Higher being...who knows..will make things right!!

I have no doubt at all that Baltovich is innocent of all this and feel really bad for what the guy had to go through.
To me the guy deserves an inquest and compensation for what we, the people, put him through. The fact that the guy is so polite and so well spoken makes me feel even worse for what he had to go through.
Can you imagine going through a trial, having the judge rip you a new asshole and then sit in a jail cell for 8 years because of Paul Bernardo's handywork.
It's just too mind boggling and awful to contemplate.

This article in Globe today by Kirk Makin outlines some of evidence against Paul Bernardo.
And by the way, Bernardo is not going to do the right thing and confess to what he did. The guy is just not human, he's a delusional psychopath and plans to apply for parole at the earliest possibility under the 'faint hope' clause.

BTW, Bernardo and Bain were both students at Scarborough campus of U of T and the murder of Bain occured during a time and in a place where Bernardo's rapes were amping up and becoming more and more violent.

That WAS true long ago-still true today but not as much so.

The thinking waaay back was "its better to have 10 guilty people go free, than 1 person get convicted of a crime they did not do"

But the courts, jury's and judges seem to no longer believe in that. Everybody seems to think it could never be THEM who would be found guilty of a crime they did not do.

The fact that Robert Baltovich supports holding an inquest is a good indication that he is innocent. Guilty people don't want more light shone on their crime.

that leads to wrongful conviction, if someone was innocent, the cops wouldn't arrest them right? and the crown wouldn't prosecute right? so they wouldn't be tried....

its innocent until proven guilty for a reason...

I did not follow the case to that level of detail. But if he knew the evidence had been lost, he could afford to ask. And he was so young when it happened, he may have convinced himself. I am not saying he is guilty either, I have way too little information. But when I read the story of how it supposedly was done by someone else, and the convoluted events that it required, it made no sense. Like the culprit having to have sneaked her away, then killed her, then sneaked her back to the spot where Truscott drove her to on his bike. Who knows.
