Even if your wife does catch you on TERB, you are now a little bit safer.
A Florida court ruled that it was illegal for a wife to install spyware on her husband's computer, in order to catch him in an extramarital affair. The three judge panel barred the woman from using the chat records from being introduced as evidence in the divorce proceedings. The court ruled that the software, Spector, violated Florida's wiretapping law - which states that it is criminal to 'intentionally intercept' any 'electronic communication.

I was thinking the same thing. But you know we follow in their shoes, so one day it will be in effect here.

....I think it's time to wash my computer files.

I'm sure that it makes every married man here feel better to know that if his wife finds out about his TERB activities he can have her arrested for wiretapping. That should smooth over the whole TERB thing and move it right to the back burner.

Legal precedents set in other common law countries are often accepted by, or at least influence, appeal courts here in Canada.

Boy, that's a pretty sweeping generalization, especially when differences in the underlying legislative provisions are not considered.

It is not really a generalization. It is just a statement of fact. They often are. But many precedents may be presented, discussed and weighed. And, as you suggest, the decision will be affected by this and Canadian legislation.

All of this does not alter the fact that a lawyer arguing a case can present precedent from other common law jurisdictions. The presiding judge does not have his hands tied by these precedents just because they are accepted into evidence.

Why would you give your wife access to your computer? XP security is good enough to keep most wives at bay. My wife has no problem with terb, though she keeps "forgetting" and refering to it as terd, which annoys me.

Especially since we have "no fault divorce" laws here, it really doesn't matter. So far as I know the only effect of proving infidelity in Canada is that you can get a divorce immediately rather than waiting a year. It would have no effect on splitting up assets, access to children, or anything else.

(Cases of physical/sexual abuse are different but that's not what this is about)

I guess that you're right as far as you take it in discussing the divorce. However, according to the article, the judge did find that she had committed a criminal offence. If the court or the crown chose to charge her with this I think it might affect things a bit.
