Parents threaten lawsuit, call for Lecce to act on Oakville trans teacher

if there's a dress code for the students there should be one for the teachers. The school just doesn't want to be sued by the Trans teacher.


Public pressure hasn’t made the Halton District School Board change its policy regarding a teacher wearing huge fake breasts to class, but perhaps legal action will.

A group of parents has hired a lawyer to push the board to take action on the dress and deportment of teacher Kayla Lemieux.



Rishi Banhu, a labour law specialist from Oakville, has written to both the board and Education Minister Stephen Lecce asking for action.

“The board has refused to enforce any standards or expectations with regard to Ms. Lemieux’s work attire,” Bandhu wrote.

His letter goes on to demand the board explain their position on the lack of a dress code for teachers when Lemieux’s style of dress clearly violates the student dress code. He also demands the board engage with parents and the school council at Oakville Trafalgar High School on this matter.

“My clients reserve their rights to pursue all forms of legal action concerning this matter, including judicial review,” he wrote.
A group of parents calling themselves Students First Ontario is raising money to support legal action against the board. So far, they have raised just over $7,500 of their $10,000 goal.

Bandhu though is looking to the province to step in and solve the matter. In his letter to Lecce, Bandhu asks him to exercise his authority under Section 303(2) of the Education Act, which would allow the minister to impose a dress code.

“A board shall direct a principal to establish a local code of conduct if the board is required to do so by the Minister, and the local code must address such matters and include such requirements as the Minister may specify,” the act reads.

Lecce has been pushing the board to take action since the story broke in September. He referred the issue of professional standards to the Ontario College of Teachers, which ruled that the board had all the powers they needed to enforce a dress code similar to the one students must follow — but the board has refused to do so.

“I think the bottom line and our position is that when kids are in front of staff, we expect them to uphold the highest standards of professionalism,” Lecce said Monday.
He specifically said he doesn’t think the board has acted appropriately in this case and called on them to do so.

Despite public pressure, pressure from ministry bureaucrats and direct pressure from the minister himself, the board has not moved. Their claim is that imposing a dress code on teachers, Lemieux in particular, would be a violation of the Ontario Human Rights Code.

Kjerstin Karlsson, a post-op transwoman, wrote after a column earlier this week to say that Lemieux’s conduct is inappropriate for a school.

“This teacher is making it more difficult than ever, even if she doesn’t realize it, for trans individuals to live their lives and be respected,” Karlsson said, noting Lemieux’s conduct could be having a negative impact on trans students as well.
“Human rights only go so far, if she wants to wear prosthetic breasts that large may I suggest a nightclub and not a learning institution.”

That is a common sense and respectful view, which can’t be said for Lemieux’s choices or the Halton school board’s acceptance of them.
If the board hasn’t acted up until this point, it’s doubtful they will change course in the face of legal action. If the education act allows Lecce to order the board to establish a dress code, he should do it.

This ordeal has become a distraction for students, parents and teachers.

He is looking for attention. Not what an educator should be doing. He should be reprimanded and suspended or come to teach in a respectful manner and appearance and not make a spectacle of himself. I've helped fund this and proud to say so.

This is the crux of the problem. There is no regulations that the board can enforce. So them doing anything comes down to either the fact that he is a trans, which curtails the rights of trans people. Or the size of the breasts, which curtails the rights of any woman with large breasts.

The board kind of put themselves in this position when they dropped the enforcing of the dress code regulations for students and staff.

So if they reinstated one for all - it would be fine, no?

I would say no prosthetics. They are not needed. Now if this teacher went to a doctor and got these done this size - they would have a different issues but banning prosthetics from everyone should be acceptable. Can a teacher walk in with a prosthetic dick at 12/15 inches in length? I think one should do that just to show how stupid this all is.

For cash strapped Boards of education, this is the last thing they would want to face. They are caught between a rock and a hard place, and it is likely they are not acting on this situation because they are hoping someone higher up takes action thus absolving them of the responsibility, and the inevitable fall out.

Congratulations woke culture. You are responsible for this nightmare and the complete inaction institutions now take in dealing with things due to fear.

Oh my, its not only that. They don't have to follow established laws or court rulings. There has been a few instances of companies being hauled off to the HRT for actions they have taken because the law says they have to take such actions, and the HRT finding the companies guilty of violating "Human rights". Yet the HRT does not have any authority to change existing laws.
So they can fine you, even for following the law, but don't have any authority to tell the courts to change the law you were following, which means if you do what the HRT says to do, you can then be sued in a court for violating the existing laws.

The HRT was the stupidest thing to ever be given power.

This is a really weird one and ranks right up there with the abortion issue. People are free to dress how they want, but there is a limit, just like free speech. The "trans" person was not showing any boob or private parts and "she" actually looks so ridiculous that the kids are more likely to laugh than to mimic anything they see in that case.

If I was a kid and something like that showed up in my class, I would be laughing so hard that I would likely have an aneurysm and convulse on the floor. That "teacher" would have no rest from the humiliation tossed at "her" from the students. If nature was allowed to take its course, the teacher would be laughed out of the school by the students themselves.

Oh well...please continue....

But aren't they just administrative in nature where they primarily provide some sort of mediation between parties? What happens if you dont abide by HRT rulings? Do the have power to enforce it?

They can fine you if they decide against you, and that fine is like any other court ordered fine.

Well the tribunal setup for that determined that they did not have legal authority to invoke that act, and they knew they didn't. They did it because they didn't like what they were protesting and wanted to send a message. But no one cares.

No one cares that their Prime Minister illegally brought in Marshal law and took away people's constitutional right to protest, simply because he didn't like the fact that they were protesting against policies he put in place.
And this asshole had the balls to label Mike Harris a dictator.

And yet the school board has not taken the bait. Just fucking amazing. Even the press hasn’t really giving the guy the attention he wants. Lol.
