I like to know if anyone on this site have initiated lawsuit against doctors and in particular a hospital for medical negligence.

I have been used as guinea pig by my doctor so he can promote a drug company and now I am dealing with all of health issues.

You been used as "guinea pig"???? How so????
All drugs have to go through clinical trials before approval, this include human trials.
There are no drugs I know of that havent been tried on humans before approval.

So unless your doctor gave you an unapproved drug, I doubt you were used a "guinea pig"

I agree, all prescribed drugs used in Canada have been approved by FDA

I was given a drug that is not approved for my conditon in Canada or FDA.

There were only 2 cases of this drug used in the world and they both failed. Doctor also never informed me about the side effects, just gave me a broucher. I trusted the doctor...

If the drug wasnt approved by the HPB (Health Protection Branch), which is an arm of Health and Welfare Canada, then your doctor broke the law.
I'm not 100% sure but I think he can be charged and lose his license.

But since this is Terb I suspect there are 2 sides to this story

OK, so, what is the drug, what is your condition, and how many second opinions do you have contradicting the original doctor's diagnosis and recommended treatment?

I smell a fish here and it ain't tuna......

The drug is approved for other conditons but not for mine. Will be seeing attorney next week....

I can't name the conditon on terb as it is rare bone disorder and anyone who google the name of the conditon will come across this post.

I have gotten opinion from Mayo and John Hopkins and both stated that there has been only two cases of usage of this drug and both are in Europe.

I was not part of any clinical trials either.

Doctors know that I have the funds to fight them(not unlimited). One of the doctor is well-renonwed in the world and I am betting that he would rather settle the matter before a court date is set. Once the the court date is set, it becomes a public record and I can ruin his name by plastering all over the internet through friends.....

Well I wouldn't start ruining his name until after the judge bangs the gavel. You'd look pretty silly doing beforehand and then losing. Not to mention opening yourself up to slander and defamation lawsuits.

He may not have told you personally, but he gave you the brochure to read. Would I be correct in assuming that all the side effects were listed there?

Don't know if all pharmacies do it, but everytime I've gotten a new 'scrip filled the pharmacist has gone over the drug (when/how to take, possible problems, etc.)

you stated that the drug is approved for other condition means it's approved by FDA plus they give you the drug literature & all the side effects are listed in there and you should be aware of.

there are lots of drugs now a days intended only for particular disease or signs and symptoms and then they discovered that may also help with other disorder

Not a drug that can cause serious infection, cancer and cost 3K a shot and since my conditon is so rare, he never paid attention to my other issues and neglected my reactions to the drug after each time I took it. He had an agenda to publish another paper.

One more item, this doctor and the hospital he is associated with put all my personal infomration on internet with my initial and my background.... it does get better...

In North America, only few dozen have this conditon.

What's the name of the drug?

At some point did you sign anything that gave permission for him to share any of your case info? If not he might get into trouble for that.

Name of the drug is Remicade....

I have lots of email exchanges with the doctors and documents from Mayo and John Hopkins..

I did not sign anything and I know I can cause them so much grief also for violating my privacy...

I do mean it that this doctor is real scared from me.
