You can do up to life if convicted of date rape in Colorado. Anyone else watch 48 hours tonight where the young black guy got 16 years to life for a he said / she said date rape in a college dorm.

Kobe Bryant could get anywhere from 10 years probation to life if he gets convicted.

No not really.

Its not a preliminary trial only a routine prelim hearing to determine if enough evidence for a trial. There clearly is its just a formality required. Most defense lawyers waive the hearing unless no real evidence at all. In this case is plenty - a victim to testify.

Speculation is if they can't intimatate the victim by having her there, which they can't, they may waive the hearing.

Misty: how do you know she agreed to it? Maybe she went to his room, then changed her mind and he pounced on her, like Mike Tyson did in his case. Kobe lied about cheating until he was caught, so there is no reason to think he must now be telling the truth. That does not mean she is either, we'll just have to wait and see.
 
I think the evidence will prove Misty wrong. Especially the tapes of her calls to the police and initial interviews.

But .. we shall all see what the real truth is, hopefully unless Kobe pulls another OJ with million dollar defense lawyers.

If a guy and a girl start to have consentual sex and in the middle of it the guy decides to get freaky and starts beating and choking her, is it then rape? Or is it still consentual?

In Canada, there is no such thing as rape... it is sexual assault

If I am not mistaken, it is consensual until she says "stop".. and if he continues after that point, it would be considered "non-consensual" or sexual assault

She was an emotional wreck immediately as she left his hotel room. She called the police the morning after. The charges weren't laid for three weeks. Not her fault for the delay.

Aren't emotional wrecks usually distant, noticably upset or prefer to remain isolated?

I don't think they're usually cheery and brag to their friends about the size of the rapist's penis.

As I am fortunate enough not ever to have been a rape victim, I can't comment personally on what would be a proper reaction.

My guess is that everyone has a different way of dealing with trauma. It is unfair to hold the victim responsible for how she reacted, IMHO.

I don't think its unfair. Especially when a man's personal life and his career is at stake. And I'm not referring to Kobe here but any man. Rape is a horrible crime and it's a horrible thing to be accused of if you're innocent (and yes it has happened).

From what I've read and heard about rape victims, they do not behave like this. I've heard they're distant, constatly feel damaged or useless, hate sex, lose imitacy with their mates, do not trust men (even their husbands in some cases, etc.

In fact, most victims have so much shame it's difficult to get any details from them.

Misty has mentioned she has worked with a women violence support group. I don't want to drag her back into this debate but if she's dealt with rape victims, I'd like to hear her input on their behaviour.

I think it's dangerous to think of all rape victims as cowering, weeping victims who don't leave their house. She may put on a brave face with false bravado as a way of coping with the intense scrutiny into her life. The people at the party may have lied or exaggerated the stories so they could sell their tale to National Enquirer. Who knows?

It's possible but without expert testimony I will remain highly skeptical.

I wonder how her behaviour has been compared to other high profile rape victims.

Rape is a horrible crime and it has a long lasting effect on women. To the people who are questioning that this girl is not showing a rape victim’s reaction. What do you want to see? Seeing the girl drowning in her tears everyday? No, that still doesn’t prove anything. Only Kobe and the girl would know what really happened that night.

If she was indeed bragging that would not fit the profile of a person who has been violated .
The supposed "bragging" about his member was a statement she made about him having a small dick at a party. Putting down your aggressor doesn't seem out of place to me.

Personally, I think she's hell bent on ruining his life. She's already been offered a buy out and didn't take it. She wants her pound of flesh.
