This is a huge development, and not what I was expecting. (In fact, didn't I read the other day that the Judge had already ordered the jury to find infringement in some of the instances alleged? Hmm. I'll have to go find that article again.)

The biggest issue was that Oracle drew a judge who knew who to code. The Judge himself became something of a geek hero when he told an Oracle lawyer something like, "You're one of the highest paid trial lawyers in the country, you should be embarrassed about trying to convince me that this snippet of code was anything more than accidentally included and of any great value.", because it was the kind of utility function that a student intern would knock off in a few hours to do some trivial task. This was a rare judge who actually had good technical understanding. Better than many managers I've worked for.
