Right, copying each others joke 100% copy and paste doesn't make you funny. Just letting you know.
It is soliciting if a prosecutor can convince a Judge that it was soliciting.
That's the only fact that matters. Heck, if a prosecutor can convince a Judge to convict because he saw you crossing the street against the light, then crossing the street against the light would constitute soliciting.
It's been kinda hilarious to see wingnuts on the left complaining that judges aren't likely to interpret the laws as written, when that's exactly what they've been crying for for the past 30 years. That we now have anarchy as a result was entirely predictable.
Now there is really no serious way to know what any judge will find, given any particular set of facts. Even the Supreme Court has said that the law is whatever they deem it to be as their whim dictates.
