I don't know if they still believe it, just that they are unsure if they can prove it in court.

if the state/government cant prove it then there is lacking evidence which may change as they investigate, I think if there was some grand master plan the feds would have unraveled it by now. In the end I think a lot of charges will be withdrawn such as trespass provided no violence was committed by that person,
