Frenchman ordered to pay wife damages for lack of sex

The 51-year-old man was fined under article 215 of France’s civil code, which states married couples must agree to a “shared communal life”.

A judge has now ruled that this law implies that “sexual relations must form part of a marriage”.

The rare legal decision came after the wife filed for divorce two years ago, blaming the break-up on her husband’s lack of activity in the bedroom.

A judge in Nice, southern France, then granted the divorce and ruled the husband named only as Jean-Louis B. was solely responsible for the split.

But the 47-year-old ex-wife then took him back to court demanding 10,000 euros in compensation for “lack of sex over 21 years of marriage”.

The ex-husband claimed “tiredness and health problems” had prevented him from being more attentive between the sheets.

But a judge in the south of France’s highest court in Aix-en-Provence ruled: “A sexual relationship between husband and wife is the expression of affection they have for each other, and in this case it was absent.

“By getting married, couples agree to sharing their life and this clearly implies they will have sex with each other.”
This is interesting. What's gonna happen if it's the other way around?

What if there was an impotence issue, after two decades should the ex-spouse now be fined for a medical issue?

How do you even put a price on lack of sex? Do they count the number of incalls she could have booked during the period of estrangement and multiply it by the going rate?

What if the wife gained 40 pounds during the marriage? Or developed abhorrent personal habits? My first wife developed a selfish miserable attitude during our marriage, to the point that I lost affection for her. I see no reason for anyone to hold me fiscally accountable for that.

If I represented the husband, I would have argued that the wife should have mitigated her damages by purchasing a vibrator. :)

It's a shame that nobody interviewed the husband. I wonder if 10K was enough, or whether he would have been willing to go higher:) For 10 Euros/week, maybe he'd be glad to keep holding out!

Bad ruling, this judgment presumes that there is an obligation to supply sex. If this president is set then men can claim the same from their wives if they do not provide sex in sufficient quantity. These assumptions go back to the days long ago where a man can divorce his wife if she can not conceive children.This ruling can not stand and will be overturned in appeal.
