I have a scc case ongoing in another province. Today we had our pre trial conference hoping to reach a settlement. He knew about it for 6 weeks but asked for an adjournment to seek legal counsel. I asked why he needed an adjournment when he knew about it for 6 weeks.

He said his daughter ran away from home and he was dealing with a medical illness, as well as he couldn't get ahold of his lawyer. I believe this to be a sympathy play. Do judges fall for this, it was a female judge which does concern me as women are generally more emotional. I attended via phone.

Judges do have some empathy and will consider all explanations even if they're bullshit. Its been my experience that woman judges can be real hard asses and when it comes to the legal profession there is very little emotion on or off the bench. for instance woman crown prosecutors are sharks. If this guy lies to the judge she will crucify him. Women can be much less unemotional in their profession than men can. Your experience in the hobby should tell you that.

Depends on the judge I would reckon. Most of them can see through whether one party is intentionally delaying or not.

I think you were trying to say that women can be much less "emotional" in their profession than men?

I would hope that everyone on the legal profession would be guided strictly by the facts and the law, but we're all human after all.
