I need some advice, this person came to Garden of Eden spa in Hamilton and took some pictures of the girls for the website. I now have found out that he is using my picture on his web page without our permision. I have tried to call, with no luck. Is this legal? Could he use my picture without my permission? What should I do.

Also he still has many pictures of different girls that work here that we didn't recieve. Is this normal? How do I know he deleted them or could he still have them and using them for something else, or worse, selling them. Some of the pics have nudity in them. Does this guy have a good reputation? Can I trust him? Am I over reacting?

If this person reads this could you please take off my picture. Just so you know which one I am talking about my name is Monique, and my picture is the one laying down on the couch with black pants and light blue shirt.

take legal action against him, if he has not taken it down within 24 hrs. No one can post your pix any where without your permission and signature.

Unless she was shot in public. Once you leave your private residence/place of business etc. and you've entered public domain your image, and the use thereof becomes public domain.

As this doesn't apply, contact the ISP that provides his webspace and notify them that he is using illegally obtained photographs.

That's Bullshit, any pix of anyone taken any where cannot be published without person's consent, that's why actors and actresses and celebs get huge legal settlements when their pix are published in the media, and they go to court!

Hey Kew, unfortunately it is not, as you put it, bullshit. I guess you are trying to tell me that at the Stones SARS concert the sun photographers went around to everyone in the audience and got releases signed before publishing the pictures in the paper? This also goes for every outside shot they've ever taken of any event, accident, or newscast.

When I went to Ryerson for photography we had an entire course on the legal aspects of being a photographer and (I forget where it is listed in the criminal code of canada) but once you're outside, your image can be captured, and used without your permission.

Famous people sue the mags not over shots of them leaving a restaurant, walking down the street etc. but for shots taken over their fences, through telescopic lens' in their backyards etc. where they are situated in a PRIVATE environment. They don't and cannot sue over shots of them even on nude beaches as long as these beaches are public. If the beaches are privately owned, then that is a different story.

If the spa paid him to take the pictures and said he could use them on his site, then he can use them. If you paid for the pictures then he should ask you if he can use them.

Either way, just ask him to remove your pictures from his site.

Pics are now off of the page. As for the images you think you may not have received, everyone got a copy of the entire shoot on CD when I was there and some of the girls opted to view their finished work online to select from there.

All you had to do was call and leave a message or email me, you obviously know where the info is since you quoted the website address. You did neither of which and decided to post on here to hopefully get some sort of scandall going. My contact info is right on the site, I don't understand why you would post on a public foum before contacting and at least leaving a message.

Maybe you should have said something when I mentioned while previewing the images with you that there's a few that I'd like to put in my portfolio....

Maybe it'd be a good idea to start recording model releases for all my shoots which would require me to know personal info like real names, phone numbers and addresses prior to shooting, then a second non-disclosure agreement just to add to the paperwork and cost. Then again I should probably charge for no shows and cancelled appointments on short notice too. I'm sure the photographers on the board that shoot for adult businesses are laughing about that idea.

Nope, I have his number. Sometimes he's away from the site for a few days. So I called him and told him someone had a problem with him using her picture. Best these things be addressed quickly rather than letting rumours spread. Dontcha think?

Let them resolve it. It's THEIR problem. I don't see any mention anyone asking you to get involved. But you seem to have a knack for sticking your nose in things.

Oh I have a life my friend. And my life is worrying about my probs, not someone elses. Just interesting to note that any controversy which happens, and has NOTHING to do with TERB, Shiek is the first to get right in there. Hmmmmmmmmmmm.
