anyone know about deeded "damming rights" on a small stream in S. Ontario?
what rights and responsibilities are conveyed?
applicable statutes? provincial? federal? (rights were attached pre-Confederation)

Depnds on the answere to a couple questions:

(a) are you on reserve/native lands?

(b) do you have a current/previous treaty to said lands;

(c) does your band accept the proclaimation of 1867 for other apects of rights, and does the fed gov't adhear to the 1867 treaty;

(d) are you in current negotiations for land/treaty rights;

(e) are you currently in negotiatiosno with either the federal or provincial gov't for any matter befor the courts...

answer is NO to all of the above.

call me foolish but I would check with my local building inspectors and see where it goes from there.

In any even if yu damn up a stream people will complain.

Permit, rights or not people will bitch.

Dam exists now and has for many decades.
'Tis the heavy hand of provincial gov't attempting to tear it down.
Perhaps my damming rights are embedded in 'common law' under 'riparian rights'...but I am only guessing, I'm no legal beagle.

In the next life, I would like to study law. Problem with lawyers is...99% of them give the rest a bad name!
