Hi,

I have not claimed Unemployment Insurance before and am just wondering what the rules regarding it are. I believe that if you resign, you cannot claim. You can only claim if you get fired, and it only lasts for 5 months?

I have a job that I hate and the thing that stops me resigning is not being able to claim UI. I could probably get a new job in a few months, so the UI would be helpful.

You won't be eligible for EI if you resign...there are circumstances when people have gotten EI after resigning, but it has to fall under one of EI's special considerations, ex: sexual harrassment on the job. In this case you would be deemed ineligible and then would have to go through the appeal process which would take several months...not worth it.

If you hate your job that much it must be causing you lots of stress. Go to your doctor and tell them you are suffering from severe stress and about to have a nervous breakdown. You need a medical leave of absence. Then you can go on medical UI. Medical UI is only for 3 months though. During that three months though you can look for another job.

The tricky part is that the stress must be real enough that not only you can convince your own doctor... but maybe a company doctor as well cause they may ask for a second opinion. It can be work related stress/burnout etc and personal causes as well. Stress is stress.
