City of Toronto Strip Club Code

While looking at the massage codesI was also interested in the Strip club laws in Toronto. I do not recall but may have missed the change a year ago making the code apply to all clubs not just those that served alchoholic beverages before. I was also surprised to see the absolutely no physical contact provision. I stay out of the city of Tornto myself, preferring the famous 3 clubs in Mississauga/Brampton since they are far more liberal than in the City. Now I know why!:

Strip Clubs Section 545
This Section Regulates Adult Entertainment Parlors which would include strip clubs that serve liquor. But in 2002 the definition of Adult Entertainment Parlors was amended to exclude the liquor requirement to be covered so all clubs whether serve liquor or not are now covered by the Adult Entertainment Providsions

HISTORY: Adopted by the Council of the City of Toronto 2002-06-20 by By-law No. 514-2002.1

§ 545-1. Definitions.

ADULT ENTERTAINMENT PARLOUR: A. Any premises or part thereof in which is provided services appealing to or designed to appeal to erotic or sexual appetites or inclinations.

B. In this definition: (1) TO PROVIDE - When used in relation to services, includes to furnish, perform, solicit, or give such services in pursuance of a trade, business or occupation, and “providing” and “provision” have corresponding meanings. (2) SERVICES - Includes activities, facilities, performances, exhibitions, viewing and encounters. (3) SERVICES DESIGNED TO APPEAL TO EROTIC OR SEXUAL APPETITES OR INCLINATIONS - Includes: (a) Services of which a principal feature or characteristic is the nudity or partial nudity of any person; (b) Services in respect of which the word “nude,” “naked,” “topless,” “bottomless,” “sexy” or any other word or any other picture, symbol or representation having like meaning or implication is used in any advertisement;

[1] ATTENDANT - Any person other than a licensed owner or operator who provides services designed to appeal to erotic or sexual appetites or inclinations at an adult entertainment parlour;

§ 545-378. Regulations for operation of adult entertainment parlours.

§ 545-395. Owners and operators not to permit attendants to have physical contact with other persons.
No owner or operator shall, in respect of any adult entertainment parlour owned or operated by him or her, knowingly permit any attendant, while providing services as an attendant, to touch, or be touched by, or have physical contact with, any other person in any manner whatsoever involving any part of that person’s body.

§ 545-396. Attendants not to have physical contact with other persons.
No attendant shall, while providing services as an attendant, touch or have physical contact with any other person in any manner whatsoever involving any part of that person’s body.

§ 545-397. Attendants to perform only within plain view of main stage. A. No attendant shall provide or perform any services as an attendant in an adult entertainment parlour except while within the plain and unobstructed view of the main stage of any floor on which such services are being provided.

AFAIK, The Toronto area does not have any Adult clubs that don't serve alcohol (except when Bunnies gets busted and loses their license for a few weeks every so often - OK.. it's been a while since the last time that happened).

Alcohol-free SCs seem to be an American fashion that never picked up in the GTA.

Interesting...since before June 2002 there was nothing in the City Licensing Code that covered them if weren't regulated by Liquor Board. So might have been a loophole but was closed last June by an amendment to cover all adult entertainment places. They also deleted the burlesque dancer definition from the probably very old .. old law.

In much of the U.S. you can't be nude under Liquor Laws only topless. So the nude clubs don't serve alcohol.

Basically you see municipalies making laws like this to thumb their noses at that Federal ruling allowing for public touching within SC. Basically they say the law is there to protect "moral standards of the community" Guess someone forgot to include politicians and greedy corporate CEOs in that too
