California sues Elon Musk’s Tesla for operating ‘racially segregated workplace’

Tesla was sued by the state of California on Wednesday over allegations that it discriminated against black employees and operated a “racially segregated workplace” within its Bay Area flagship factory.

California’s Department of Fair Employment and Housing said it filed the lawsuit in Alameda County Superior Court on Wednesday, but the suit — which Tesla called “misguided” — has not yet been made public.

The suit includes allegations that Tesla managers, workers and supervisors at its Fremont, California, factory used racial slurs including the N-word, “monkey toes,” “porch monkey” and “hood rat,” according to a copy of the suit obtained by The Post.

Black employees also allegedly saw racist graffiti throughout the factory, including phrases like “all monkeys work outside,” “fuck [N-words]” and “hang [N-words]” next to a drawing of a noose, the outlet reported, based on a copy of the suit.

Managers at the Elon Musk-owned automaker either participated in or overlooked the racial abuse and gave black workers more grueling work while passing them over for promotions, the suit claims.

In a statement to multiple news outlets, California Department of Fair Employment and Housing chief Kevin Kish said the suit was based on complaints from hundreds of Tesla workers.


“[We] found evidence that Tesla’s Fremont factory is a racially segregated workplace where Black workers are subjected to racial slurs and discriminated against in job assignments, discipline, pay, and promotion creating a hostile work environment,” Kish said. The California agency didn’t return multiple requests for comment from The Post.

Tesla called the suit “misguided” in a blog post published on Wednesday before news of the suit was made public.

“Tesla strongly opposes all forms of discrimination and harassment and has a dedicated Employee Relations team that responds to and investigates all complaints,” the company said, adding that the alleged misconduct occurred from 2015 to 2019.

“Tesla is also the last remaining automobile manufacturer in California,” the company added. “Yet, at a time when manufacturing jobs are leaving California, the DFEH has decided to sue Tesla instead of constructively working with us. This is both unfair and counterproductive, especially because the allegations focus on events from years ago.”


News of the suit comes months after Tesla was ordered to pay a whopping $137 million to a black former contractor named Owen Diaz who said he suffered racist abuse at the Fremont factory in 2015 and 2016.

Diaz’s lawsuit against Tesla contained some material that overlaps with California’s suit, including allegations of racist graffiti and use of the N-word.

“Tesla’s progressive image was a façade papering over its regressive, demeaning treatment of African-American employees,” Diaz’s lawsuit read.

Musk's managerial style and treatment of his employees have been heavily criticized.[166][167][168][169][170][171] One person who worked closely with Musk said he exhibits "a high level of degenerate behavior" such as paranoia and bullying.[167] Another described him as exhibiting "total and complete pathological sociopathy".[167] Business Insider reported that Tesla employees were told not to walk past Musk's desk because of his "wild firing rampages".[172] The Wall Street Journal reported that, after Musk insisted on branding his vehicles as "self-driving", he faced criticism from his engineers, some of whom resigned in response, with one stating that Musk's "reckless decision making... ha[d] potentially put customer lives at risk".[173] The 2021 book Power Play contains multiple anecdotes of Musk berating employees.[174

Tesla has faced numerous complaints over workplace harassment and racial discrimination,[253][254] with one former Tesla worker who attempted to sue the employer describing it as "a hotbed of racist behavior".[255] As of December 2020, only four percent of leadership at the company are African American and seventeen percent are women.[256] One female engineer at Tesla filed a lawsuit describing a culture of "pervasive harassment",[257] (the lawsuit was dismissed with prejudice[258]) and a former black worker described the work environment at Tesla's Buffalo plant as a "very racist place".[259] Tesla and SpaceX's treatment of Juneteenth in 2020 also came under fire.[260]

Approximately 100 former employees have submitted signed statements alleging that Tesla discriminates specifically against African Americans and "allows a racist environment in its factories."[261] Furthermore, in July 2021, former employee Melvin Berry received $1 million in his discrimination case in arbitration against Tesla after he claimed he was referred to by the n-word and forced to work longer hours at the Fremont plant.[262] The accusations of racism culminated in February 2022 with the California Department of Fair Employment and Housing suing Tesla for "discriminating against its Black workers."[263]

Musk's work behavior
Musk specifically has been criticized for his increasingly erratic behavior,[264][265][266] including an acquaintance of Musk's who described what they saw as a "high level of degenerate behavior", paranoia, bullying, and tendencies of "total and complete pathological sociopathy".[267][268][269] In 2018, Tesla board members expressed concern regarding Musk's use of Ambien and recreational drugs.[270][271] Wired noted that Musk was known amongst employees for his "unpredictable rages",[267][272] and Tesla employees were warned not to walk past Musk's desk because he was so prone to unexpectedly firing people.[273] Ex-employees said that Musk would change the direction of the company "literally overnight" based on what was making news on social media.[274] Several professors have noted Musk's narcissistic tendencies, and the problems this could cause for Tesla.[275][276] The Wall Street Journal reported that, after Musk insisted on branding his vehicles as "self-driving", he faced criticism from his engineers, some of them resigning in response, and one highlighting Musk's "reckless decision making that has potentially put customer lives at risk".[277]

Tesla has also been criticized for its high level of executive turnover.[278] With the departure of Alan Prescott in April 2021, Tesla has had four general counsel departures since 2018.[279]

Promotion of bitcoin

Tesla and Elon Musk have supported and promoted the cryptocurrency bitcoin.[280] Tesla began accepting bitcoin as a form of payment for its products in March 2021, but reversed its decision in May 2021.[281][282] Tesla and Musk have been criticized as being hypocritical, since Tesla markets itself as a sustainable and environmentally friendly company, while bitcoin is environmentally unfriendly due to the large amount of energy required to "mine" new bitcoin.[283][284][285] At the end of 2021, Tesla still held nearly $2 billion in bitcoin.[286]

Musk has also been accused of market manipulation by using his Twitter presence to pump up the price of bitcoin[287][288][289] and dogecoin.[290]

Failure to abide by license agreements
Prior to 2018, Tesla used modified versions of the Linux kernel and BusyBox in their vehicles without freely distributing the derivative software and its corresponding source code, which is mandatory under the licensing terms of these products, the GNU General Public License (GPL).[291]

From 2013 to 2018, a number of complaints were made to the Software Freedom Conservancy (SFC), which privately attempted to negotiate compliance before pursuing litigation against Tesla.[292] They announced in 2018 that Tesla achieved partial compliance and had promised to release more of their modifications in the future.[293] As of late 2019, the SFC claims that Tesla has not yet delivered on this promise.[294]

You think rich white people care about the dirt poor in Kentucky. That is sort of the model everywhere as far as I can tell.

Probably around the same amount as with other races. Every time i see a massive NBA star's house, far from the hood, I know the answer.

Tesla worker rejects $15 mln payout in race bias lawsuit


June 21 (Reuters) - A Black former elevator operator at Tesla Inc's (TSLA.O) flagship California assembly plant on Tuesday rejected a $15 million award in his lawsuit alleging racial abuse by coworkers, opening the door for a new trial after a judge slashed a $137 million jury verdict.

Lawyers for Owen Diaz, who had sued Tesla in 2017, turned down the judge's award in a brief filing in federal court in San Francisco. They said in a statement that the award was unjust and would not deter future misconduct by Tesla.


"In rejecting the court’s excessive reduction by asking for a new trial, Mr. Diaz is again asking a jury of his peers to evaluate what Tesla did to him and to provide just compensation for the torrent of racist slurs that was directed at him," his lawyers said.

Tesla did not immediately respond to a request for comment.

U.S. District Judge William Orrick lowered the jury award, which was one of the largest of its kind in a discrimination lawsuit, to $15 million in April. He had also denied Tesla's motion for a new trial, conditioned on Diaz's acceptance of the lower award.
