Kinear was in charge of the strike when he promised there would be no walkout if contract was voted down. As a result of the walkout, TTC was declared essential and cleaners have been privatized and the public hates the union. The union members then voted him back in. Before the last election he resigned then changed his mind and won the election. This nonsense alienated a lot of board members and caused international to declare a re-election which he won.


He is currently fighting against drug testing and is in the courts wanting the right to strike back.

He is trying to break away from international - "they treat us like a colony" - and they have just responded by taking over the Toronto Local 113 claiming he has " violated various union rules and regulations and places control of the union in the hands of Manny Sforza, an international VP of the ATU who was previous VP of the 113"


CUPE 5089, the local that represents special constables and fare inspectors at the TTC, tweeted that the move was "excellent news," and that a leadership change was long overdue.

This is a classic international vs. regional local internal union battle. Usually the regional local(s) get fed up with the international and when the international tries to drop the hammer an all-out war erupts. Sometimes the international wins, sometimes the regional local wins. The trend seems to be a splintering of international unions. Time will tell.

It's all about the money. Lots of money. Free money since they don't have to work for it.

Unions are big money for union bosses. (That's why to get rid of them you need a D9 to drag them out by their heels.)

I wish that the unions had to publish the salaries of their employees, especially the bosses. I think the public would be fucking shocked if they saw how much money a lot of these guys were bringing home for doing nothing.

You're absolutely right J T K. If the guys they represent knew how much more these guys get, they'd be stunned too. Some of these fukkers earn their wage, plus a union wage and get a second pension as well, under the union, on top of their work pension.

There's only 1 issue.

Money. Lots of fucking money.

If the Toronto local breaks away the American union bosses lose a big chunk of free money and they don't like that. Not one bit.

They have flown in leaders throughout Canada to support them but courts support Kinnear. What he is doing to seeking a democratic vote among members which the The Canadian Labour Congress supported (but has now withdrawn support) and international ATU by laws make impossible so he is doing an end run around them through courts

That is WTF I think is going on

The last things ANY Union wants is fairness, democracy, transparency or the rule of common law.

The entire labour code in Ontario was written 100 percent by the unions themselves and is 100 percent biased in favour of organized labour. The rules of justice and fair play simply do not apply. 1 guy voting for a union is enough to unionize a company of 1000 workers, even if 999 of them were opposed to unionization. The union simply has to card that 1 guy who happens to be at work on a Sunday when no one else is and bam, congratulations to ACME ACE Construction Inc, you are now unionized whether you like it or not and there is NOTHING you can do about it. The province of Ontario will back the union up to the end of the world. Unions and those who operate them are criminal organizations. They wrap themselves up in the mantel of protecting workers, but it's really all about them. It's just about the money and the workers are just pawns in the union's pockets.

I love seeing a guy like Kinnear get royally fucked by the very criminal legal system that he helped put in place. Makes my day in fact.

The legal fight for control over a union representing more than 10,000 TTC employees was back in court today as the reinstated president of Amalgamated Transit Union Local 113 asked a judge to toss a rival leader in jail for violating a previous order.


Bob Kinnear, who is the longtime leader of ATU Local 113, and his entire executive board were ousted from their roles on Feb. 3 after the union’s American-based parent organization placed the local under a trusteeship and put international Vice-President Manny Sforza in charge. A total of 12 members of the executive board were then reinstated later that day after they reportedly signed "loyalty oaths" to the American union.

At the time, Sforza accused Kinnear of “single-handedly and secretly” attempting to end an affiliation with the ATU and deliver his members to Unifor. Kinnear, however, argued that he only wanted to give members a chance to vote on which union they wanted to be affiliated with and accused the parent organization of suppressing democracy. Kinnear then sought a court injunction to regain control of ATU Local 113, which he was granted on Tuesday.

Just hours later, though, the executive board of the local passed a motion of no-confidence in Kinnear’s leadership and two other elected officers who purportedly helped him in pursuing a split with the ATU.

"A Canadian court has upheld a democratic vote of our members to elect their chief representative,” Kinnear said in a statement released after that vote. “Now this executive board thinks it can simply ignore both the vote of the members and a court decision upholding that vote."

The motion that was put before an Ontario Superior Court justice today asked that Sforza be found in contempt of the Feb. 21 court order and be fined and imprisoned for “such period and on such terms as the court directs.” The motion also asked the judge to make an order, barring Sforza and the Amalgamated Transit Union from “threatening, intimidating, or otherwise communicating directly or indirectly with any officer of Local 113.
