blackberry spying?

in a business where employees are given blackberry's for work purposes..does the employer have access to the workers phone contact list..and maybe even to their bbm chats with other employees?
I have a relatives contact info on my blackberry..same last name and for some very very odd reason my boss ended up accidentally calling them. The boss still hasnt given me an explanation as to how she ended up with my contact persons phone particulars. very very fishy...help please

If the phone was bought by the company and is Paid by the co. It belongs to the company and they have the rigth to access any information stored in it. They can trace all your calls and bbms. Do you back up your phone on a company's computer? If so IT can access all your address book and contact.

Now they can even trace you wherever you are. So if you call in sick, however you are Playing golf, etc. make sure you don't carry your cell phone as your employer can pinpoint your location.

If your Blackberry is joined to a BES server (blackberry enterprise server) everything and I mean everything is synced to your companies BES server. In Canada the data on the phone is the property of the phones owner, even if you didn't sign a disclaimer they still have assumed right when you joined it to the corporate network.

I believe there has to be a written policy in place and all employees must be made aware of it.

That's probably true but makes no difference if it is or not. If an employer issued you a BB, make the assumption that the employer uses it to track employees.

Similar policy: During job interviews it's against the law for the employer to ask the potential employee's age. Not supposed to happen. Happens all the time.

the second one is true, however without a clearly understood written policy, the employee can claim ignorance should there be a HR issue - seen this a few times in terms of emails etc.
