Beyond rude neighbours(venting)

Sorry, but I need to vent. New neighbours have moved into my basement. In less than two weeks, the police had to come here five times. It is getting damn annoying. I've gone from being worried for the girl and her baby to just fucking pissed. So much so I'm thinking of moving. Again. The most annoying thing is, two times the police were called around 3:00AM. And, they come to my door, instead of the side door. So, I wake up, have the police come to my door asking for my neighbours. At three AM, seeing an officer at your door is a little disturbing. Then, frustrating when you find out it's for them, again. And worst when you have to give a statement, which you know nothing about. "Well, officer. I woke up when you rang the doorbell. That's the earliest I can remember." I'm thinking of calling my landlord. I doubt he can do anything, but still. Anyways, had to vent. Thanks for listening.

Wow, that sucks. Why don't you just kick them out? Why did you allow them in your basement in th first place?

Just tell them to get the hell out of your house. If they can't be considerate and grateful enough to not be a nuisance, they have no right being there.

As Jennifer stated, I rent. Otherwise, I would have kicked them out. Ironically, it looks as it it's I who will be moving. The landlord doesn't seem able, or willing, do to anything.

By law you have a right of quiet enjoyment. Send a registered mail letter to the landlord demanding that he enforce the lease, whether that means warning them in writing first or evicting them.

I agree with RFJ, by law you have certain rights as a tenant. Landlords are doing their best to "Lure" tenants into their buildings (whether its a house or apartment). They advertise first month free, no first and last month deposit, free pool, exercise room, etc. Talk face to face with your landlord, let him or her know that the police have been there five times in two weeks. Bottom line, you will leave unless he deals with the problem. If you have been a good tenant, he will do the right thing. If he doesn't....speak to somebody in legal rights about who you take your case to.

Don't give up and (longer term) work on getting your own piece of real estate.

Can you not put in an application against your landlord and against your neighbors with the tribunal? If I were you I would go into the tribunal and talk to one of the persons there and tell them your story and see what actions they can do for you.

since there is a baby involved you may want to consider contacting CAS or CCAS and look after what is best for the child and i do not believe the child is in the best enviroment he could be at

Talking with the Landlord isn't enough. You have to document it. For all intents and purposes, the Tribunal will expect a written complaint. Send it registered mail. Eitherwise it will be your word against the Landlord. Nothing better than waving a written notice before the Tribunal.

That might be true about the Child not being in the best enviroment but the mother might not have a choice as well and calling CAS CCAS might not be the best thing if the Child is taken away. The police would have already done so if they thought something was wrong.

Is the basement apartment legal? I think probably not since the police don't seem able to discriminate between your place and theirs. You might be able to use this as leverage to get the landlord to deal with the problem.

The basement apartment is legal. As Jennifer said, whoever calls neglects to tell them they live in the basement. When I've heard them call, they aren't in the most sensible state of mind. Then again, I doubt most people are when they call 911. Their is no tribunal. Just the landlord, who is trying to please both of us. Can't blame him. He's a great landlord, he just has a few lousy tenants.
