Americans taking Canadian jobs...

I'll bend it like........
I've been working with one of my clients in London, ON and in the last 6 months I've noticed they've laid off a few people and brought people from the head office in Michigan to replace them. I'm not talking a couple of weeks here, I'm talking 3 to 4 months so far.

One of the employees told me in confidence that he was afraid his job would be next to be replaced by and American and not sure what or even if he can stop it from happening. The problem is they are still being paid by the head office so there's no payments coming from the Canadian office.

Can anything be done or even proved?

Employment is not a right. So long as a person is given proper Notice (or pay-in-lieu of Notice) and severance pay (if applicable), an employer can terminate your employment relationship at any time.

If you have a written employment contract with different terms of termination, or if you're unionized, the rules for termination may be different.

So long as an incoming American has all the proper paperwork there is nothing illegal happening. Although if the American needed a work visa there may be issues with laying off a Canadian to give the job to an American. But that's beyond my area of expertise.

Under NAFTA, an American can work in Canada for a "temporary" amount of time. Similarly for Canadians working in the US. I think it's 6 months.

Longer than that requires sponsorship for the American (as entrepreneur, skilled immigrant, or other category). And the Canadian employer needs to show that despite all efforts to hire Canadians, none were suitable.

They are probably closing up the Canadian branch and bringing in Americans from the head office to wind up operations.

I work for a major US corporation, and we have a bunch of Canadian Branches...and they are all headed by yanks who fly up monday's...stay in hotels...live like kings...and fly home thursday night's. Obviously not the best way to save money during the "recession"...but it's the way it is and I have no issues with Americans doing this.

I have a sister who works down in the states taking a job from an american, so it all balances out

Just flying up and working for up to 6 months sounds too easy. If that were the case, all sorts of Canadians would be working half the year in the States - all with no paperwork. Sounds fishy...

I won't mention names but there are U.S. companies recruiting teckkies in India for jobs in the U.S. These Indian teckkies are willing to work for low wages because they want a ticket into the U.S. Trying to get a U.S. "Green Card" takes forever so these U.S. companies "park" these Indians in Canada until they get their "Green Card".

I'm 50/50 on this.

It is not right and then again it is right. It give a job to a person who really wants to work then again it takes away a job from a Canuck, who has already been here. There is so much I can say about this. There are "different nationalities" are willing to work for less, but to be honest most of the people will run circles around you from the knowledge that they know for somone who has been int he business for 20yrs or more..



I don't know how word gets out. I'm receiving at least 10 - 20 resumes at day and they are mostly from the U.S. Honestly they are very impressive resumes but there are a few reasons I will not hire right now. 1. I'm not hiring as my company is just as efficient at what it is set up to do right now. I have been one of the lucky guys in the business. I'm getting lots of contract work coming in from all over the place. 2. If I were to hire, I will look for someone here in Canada first, rather bring someone from the U.S up here and pay them in U.S. funds. No way in hell will I do that now, but there is more to it.

Are these management positions ?

I have imported senior guys from the US based on finding the best possible person ( don't get excited OTB he was a euro with a green card and not a real Yank) and there is a work visa procedure to follow. As long as this is being followed I see nothing wrong.

It's also fairly typical for a US company with a Canadian or other foreign subsidiary to rotate staff through the subs as career path training or penance depending on whether it is London or Fort McMurray.

I work at a Canadian multinational bank where HQ is laying off Americans in the Northeast and guess what? Me and several hundred Canadians will be down there for the next year - maybe two or three.

It all works out in the end. I know this is TERB, but don't just look at things one way. Though I get paid in American dollars.

L1 Visa. Most of us live in the States. Several, like me commute every week.
