Ive lived in my apt building for 7 years, have had an air conditioner all that time. Now we get a notice saying they wanna charge us 20 bucks extra a month for having an air conditioner. Just for the summer months, but in our rent its evrything included.

So 2 weeks ago we get a letter saying that they are having a fire company come in, and check all the smoke alarms and carbon detectors. They do this every year, so no big deal. So 2 days after we received the notice, the fire company comes in and checks, and with them is the property manager, and he proceeds to check out every room, for air conditioners, and goes out on the balcony and checks for BBQs.

My question is , i know they have to give 24 hours notice to enter the apartment, but the notice we got was for the fire company, to check the alarms, not to walk around and do an inspection on the apartment, to find out who has Air conditioners.

Did the property manager have any rights to enter our apartment, to me it was under false pretenses.

I don't think they can arbitrarily add $20 for an air conditioner. If they do, pop it out and hide it, then have the super come in and see that there's no air conditioner. Have a memo to that effect ready fir his signature.

If your lease does not specify extra charges for AC then they can only charge you when and if there is a new lease.

Related to the above, although I do not practice in Ontario, I presume that although you have lived there for seven years, your lease has been for for one year renewable. (when it renews, everywhere I am familar that is a new lease, I have no reason to believe that is not also true in Toronto).

you could always request a show cause case in court.


that is to say cause as to why 20 dollars is the anticipated cost of the unit.
