In at least a few incidents performers were sexually assaulted. The website shut down and paid millions of dollars in damages in a civil suit; what does that tell you about their practices?

It's kind of a no brainer that the publisher should verify the source of the received material and Pornhub should pay fot that oversight. That said allowing underage and unconsented videos to be uploaded is the same as condoning it and as the owner and operator of the site they have a moral(and obviously legal) obligation to do better.
