It's Murder One. What's the criteria for opting for the death penalty.

Regardless of how hot the guy is, if you stalk and kill third parties, it's going to be a highly unpopular move.

Of course murder is wrong, and he needs to be punished. However, it seems that they are really making an example out of him. Seems that certain lives are more valuable than others.

Premeditated and shot him in the back in public...Sounds like a death penalty case to me.
Some states have that "lay in wait" type clauses which make it death penalty eligible too.

Might as well start there. Use it to bargain down a life sentence without parole. Government should probably do that, because, if it goes to trial it will be a circus and he'll get a big supportive crowd and the insurance companies will actually be on trial as much as Luigi.

Dude...there are people waiting on death row...the guy planned and shot a guy...that's murder...if that was your brother or best friend...would you settle for less?
