So long as its equally applied to both genders (which we all know it wont be).
If a woman removes her condom or "forgets" to take her birth control, the law and subsequent penalties should apply to her as well
I wouldn't say birth control is 100% the same thing. For one, birth control has no impact on the transmission of STDs, in the same way condom use does. It's an interesting question though. Is this law designed with STD risks in mind, or pregnancy risks?

it just recognizes that an act with condom is not the same that the bareback. Much like yes to vaginal does not mean yes to anal or pegging. Ignore the above lame attempts to create fake symmetry between men and women.

IMO it should be both.

I remember 25 years ago in the US there was a case where a girl got pregnant even though she had insisted she was taking birth control.
The man who got her pregnant was a very wealthy multi-millionaire.
Her intent was clear, she wanted to have a child with him so she could trap him into child support.

The man got a court order for her prescription pills.
The pharmacy documents clearly showed that she didnt fill her prescription pills for about 6 months or so.
It was during that time that she got pregnant. So she lied about taking her BC pills.

The whole case turned into a huge mess because obviously he still wanted to support his kid, but he didnt think it was fair he should pay all the child support she requested (which was in the tens of thousands of dollars)

I dont remember the outcome because back then there was no internet coverage.
I only remember reading it in USA Today when I was on spring break in Florida

I know some pro athletes and they are briefed each year to not believe "it's OK to not use a condom i'm on the pill" from any lady. Always use a condom. Yet, you end up with cases where a player in his 20s will have 12 kids from 10 different women..

Should be both. Consent is consent. Lots of guys are expecting her to mean it if she says she's on the pill. And not to prick the condom

This is one of the main reasons why the majority of professional athletes go broke only a few years after they retire from their sport.

I think it would be much harder to prove than a case where there was no consent to any sex at all.

Agreed, it is a form of assault because there is no consent for non condom sex. It is easier in the case of an sp that has a clear condom only sex policy . In civilian sex, where alcohol and drugs may be factor, it might be more difficult to determine exactly what transpired to get a conviction, but at least now it might give pause to those individuals that felt that they could break the law and get away with it.

In a lot of cases it will easy to prove. So many people meet and converse online, through text, etc. I am sure many people discuss use of condoms ahead of time.

also…. Was there a condom when act started? Where was the condom when the act finished? 6 inches up her vag? Or 6 feet away from the bed?
