Government can and does direct policing through LAWS & often through funding specific operations like northern spotlight.
C36 is NOT about trafficking! It's about making the purchase of ADULT sexual services illegal and the provision of such services by a commercial enterprise (group/business) illegal.
By-laws are irrelevant to enforcing the Canadian criminal code.

Nah, i think that its MPAsquared that has an issue with hotels and condos, cause the escort industry has kicked the living snot out of massage parlours over the years. Cops have visited every incall in the city at one time or another on bogus tips of underaged girls etc. by certain people, *cough cough*............and they visited when operating a common bawdy house was illegal, and living off the avails was illegal or being found in a common bawdy house was illegal. They made sure the girls were of age, AND SAFE..............then said goodbye.................as they will continue to do after Dec 6. Just my 3 cents.

Cops have better things to do than park in front of hotels, condos or massage parlours busting a guy who wants to get laid. They will however, go after human trafficing, underaged girls, and exploitation as hard as ever. which in my opinion, they should. in the good old U S of A, it is much more illegal on all angles than here, and agencies and escorting are as busy than ever. We had a very long and interesting discussion with Allan Young just recently. The sky is not falling lads. There is a plethora of legal ways around that insane law. Needless to say the first guy arrested can claim entrapment and will get thrown out on the spot. He is purchasing a service that is legal to advertise and sell. Happy hobbying.

not to mention something like 2000 massage parlours. These places would crop up faster then LE could shut them down. LE can't just raid any place they want, it takes weeks of investigations and warrants to be able to raid a place.

Hi Everyone,

I dont often hit the lounge but wanted to weight in on this. I am a lawyer and the biggest issue that I see for those that hobby with reputable in call/out call establishments is there private information. This has always been a concern of mine but this is escalated with the new potential changes. In particular, agencies and SPs receive clients cell phone numbers and many keep them for frequent user awards etc. The issue is if there was a search warrant, the phone records could end up as public information (even if charges are never laid against the client). I think the most important thing that everyone could do is encourage indys and agencies to take steps to ensure those records are never kept at the appointment is complete and to ditch things like frequent user records. My concern is that this may not happen because indys and agencies will want to keep them as they feel more comfortable providing services to existing customers.

I dont anticipate that this legislation will survive SCC challenge but my theory is the government doesnt care. They want to show their supporters they are doing something and so they will allow years to go by before it moves up the Court system and will not refer it to the SCC.
I have spoken privately to agencies and they have assured me that they will delete these records at the end of each week or sooner.

In any event, I intend to buy a pay-as-you-go hobbying cell in the next week to cover my ass. And I always use a fake name when I book.

And as well, while it may seem elementary deduction that a guy pays a large-ish sum of $$ to have sex with an attractive younger woman, it doesn't play out that way in criminal court where the Crown has to prove each element of the offence beyond a reasonable doubt. It's pretty difficult to prove that sex took place just from phone records. After all, the celebrated 19th Century British prime minister Gladstone used to book street girls several times a week and would just read the Bible to them and attempt to reform them morally - or so he claimed. Since he was the most powerful man in England, no one ever argued with him.

Not true. Most are holistic licenses. The city made a # of errors when drafting those bylaws, there are numerous loopholes that allow holistic's to operate as bodyrub parlors. It is not easy to shut down a licensed holistic center. Not impossible, but not easy. The city doesn't know how to control the issue. Its been a subject of many many meetings w/MLS.

I think it's funny that some people are like "yeah just quit you're breaking the law" and then when you say you are not quitting, you get vilified for it. So what's the alternative then a life of celibacy? all so I can avoid the risk of a $500 fine? I get it for some people even a small risk is not worth it. They have careers, reputations, families, fine. but for some of us. We can't just "quit" I will be taking a break. I need it anyway. My wallet needs time to recover and I should just focus on other things. but am I out for good? Nope.

Depends on who is making the local police policy. York Regional Police have sometimes believed they had nothing better to do than busting guys who want to get laid.

Enforcement varies in the US as well. San Francisco and Santa Clara have the same California criminal code but VERY different levels of enforcement. We can expect that to be true in Canada as well.

Net result in the US is about 80,000 arrests a year for prostitution, since the US is ten times or size we may see anywhere from 4000 to 8000 arrests a year, Canada wide, with some jurisdictions arresting a lot, and others only a few.

That is naive. The police don't catch every single speeder either, they just catch enough that everybody else keeps it within reason. A fairly small amount of police enforcement has a fairly large effect on public behavior.

IF the police start busting a certain type of business they will NOT keep cropping up. People do not line up to be arrested, they change behavior to avoid arrest, even if statistically only a few are actually getting arrested.

In jurisdictions where prostitution is aggressively enforced establishments go underground, stop advertising, etc., they do not just carry on openly hoping they win the dice roll.

Cops aren't stupid. Pimps have moved on from basement appts & cheap motels. They are following the problems. That is their focus.
