i typed up a really good response then deleted it since this has gotten boring. i get that you dislike smokers, that's fine, some of us are ignorant people. over eating and being gay are choices just like smoking and people get fired for both of those, since you have no sympathy for them and you must think they deserve it as well, i guess our conversation is over.
Actually all my friends are smokers, and my parents too. I wouldn't call them ignorant or suggest I have a dislike for them. I just took into consideration the context of his business. Until someone challenges the existing legally binding court decisions, then nobody is in the wrong. Not including the other businesses that adopt similar policies.

oh not all smokers are ignorant but there are quite a few that are. i am a smoker and i see the way they act and it is offensive to me. standing by the door of a mall and making it so people have to walk in a cloud to get in, that is ignorant.

what i am trying to get across is that if you let this guy discriminate for this character trait and get away with it, the next guy will pick another trait and then the next guy and the next and soon we will be back where we started in the 60's. follow what i am saying now ?

I won't argue the financial cost to the heathcare system, because it's likely possible to spin them anyway you want. If a guy who quite smoking 2 years ago has a heart attack, was it caused by his past smoking, his questionable diet, the stress at his job or his lack of staying fit? There's no way to determine that other than to say it was likely a factor.

Simon, based on you are saying, it seems you are fond of your vices. You should probably keep smoking or you'll be so pure we won't want to talk to you anymore! ;)

i am not really fond of the vices i had since it is likely that they would have killed me in time. talk to people about how much i used to do and they are all in shock and say i should be dead already lol. smoking is my only bad habit i got left, i do enjoy it but i do know it's time to get moving on that as well.

it's more if you let this guy do this then where do you stop it.

well now he has done it and gotten full support for it since he picked the habit no one likes, more company owners will climb on here and use it to take a little more away from you each time.

but smoking is the habit you can see. what if the guy that doesn't smoke goes home and drinks himself into a coma every night or mutilates cats int he alley.
If I knew about it, I wouldn't hire them either. You make hiring decisions on limited information, so you have to use the information you do have even though it isn't the whole story.

If I have two candidates that otherwise seem equivalent but one has an obvious character flaw I will pick the guy without the obvious character flaw. He may have a hidden character flaw, but from the limited information available to me he is the better choice.

There is no redeeming value in someone being a smoker, there are only negatives.
