Anyone know much about divorce law?

If you catch your wife cheating, does she still get half your stuff if you divorce her?

Phone the Law Society of Upper Canada and ask for their free lawyer referral service but tell them you want a lawyer who specializes in family law. Most of these lawyers offer you one free consultation and then you can find out where you stand.

There's a difference between divorce, a federal matter, and the division of assets, a provincial matter. She can be fucking an entire football team on your bed and it wouldn't affect her rights to equal share of the family assets, unless its been modified by a marriage contract. You should go see a lawyer for details.

I've been through one divorce and it's not easy if both parties are not consenting, because the judge will ask if both parties feel the same way and if there is any chance of reconciliation. When the judge asked us if we both wanted the divorce we both said yes. When he asked if there's any chance of reconciliation we both said no. If she doesn't want the divorce she can contest it and that's when it can get messy.....and very expensive! So consult a lawyer and think very carefully if it's what you really want to do.

seperated for a year and a half
have a 6 year old

no law contract or great lawyer can protect assets, unless otherwise stipulated in a seperatly aquired agreement
work it out with your wife
agree to the terms of a seperation agreement, this agreement lays out financial compensention, allamony, child custody, and visitation.
once you agree on these important issues then have a laywer prepare.
after living appart for at least a year, once granted from a judge you can make the seperation agreement the divorce agreement
its better to work it out independently of a laywer.
all being said, any agreement can always be reopened.

The only difference infidelity has on a divorce is that a divorce can be granted without having to separate and live apart for one year. As far as the division of assets, that's a who.e new ball game! As someone stated earlier, if you can work things out without seeing a lawyer, that's a plus, but you still need a lawyer to draw agreements up, etc. infidelity has no bearing on how things are divided.

It's high time we grasped that marriage is one thing, children another and property a third and stopped merrily rolling them into one, because love has addled our brains. The Courts and the law started moving out of the XIXth C quite some time ago. We should try to do the same.

Means jack shit. What you need to do is start playing dirty and hiding your assets and mortgage the home to the tits and enjoy that money. Once you file- she'll get more than half.

Hmm, sounds like "improvident depletion" to me. That'll bring you under the provision in the Family Law Act where the judge will give her a lot of extra $$$$$ as a sanction against you.

is it true that if one spouse leaves the house during separation, the law can deemed that he/she abandoned the house and the other spouse can take full possession of the house and keep it all to himself/herself??

well since this thread is already here, i have a question myself. My ex and i are coming up on our year of separation. I have had a few people tell me that when you separate, you must file something with the courts saying you are legally separated....is this true? because i dont particularly want to wait another full year in order to have a divorce granted.
