Also, doesn't Silverman bear some liability? He is seen in the video pushing the door shut to keep the optician in the store. He's not a cop; couldn't that be forced imprisonment?

I agree that the optician should be charged with assault and battery, when he was on the street. But doesn't he also have some right to throw someone out of his store? At the very least, that would be debatable as to how much force he can use to remove someone from his private property.

What are you talking about? there is no debate at all...

1) Silverman has no liability. Plimmer was assaulting him so he held the door shut to keep from being further assaulted; thats called self defense.

2) Sure Plimmer has the right to throw someone out of his store. Problem is Silverman wasnt in the store at all. He was outside when this nut case attacked him.

Well, that's the way it can go, but where do you draw the line? When one uses a weapon? A pipe? just fists? All altercations should be dealt with....

Anyhow, as for the forcible confinement comment, Silverman was trying to hold the door closed to prevent the wingnut from assaulting him further. No law against that......

Great advertising for the shop is all I can say.....That'd be about a 9.9 on the OOPS scale.....

According to the law, I believe even laying a finger on someone without permission, as is spitting or pushing, deemed assualt. I'm not arguing about the law's definition of assault.

What I'm saying is that these acts don't cause any real physical harm. Silverman wasn't even close to getting hurt. The optician had a threatening manner but he made no attempt to actually hurt Silverman.

Do those actions warrant being arrested and maybe convicted, screwing up someones career? Not IMO.

Having said that, he went psycho and resisted police arrest, but that's another matter.

Idiot, that's an understatement. He's a fucking asshole that should be put out of business, and get locked up for about a year.

I like to see how he would try pleading not guilty to that.

Maybe not to a younger person. Remember, Silverman is 75yrs old. Generally speaking, a 75 yr old couldnt stand up to that as well as say a 25yr old. You forcefully slam a door into someone that age and you could break bones as their bones get frail at that age...he could have a heart attack...anything could happen.

That nut is just lucky that Silverman is ok, but does that make it right?

If his career gets screwed as a result...guess whos ultimately responsible for that? He didnt have to behave like that did he? There is absolutely no reason for that event to go down...none at all. This man is 33 not 13, he certainly should know better but he did it anways. if his career goes down the tubes...thats completely on him

Didn't see the story, but it when I read optician and "a few fries short" in this thread, my only thought was, it must be that guy near King W. and Shaw. I had an encounter with him away from his store and felt uneasy because he just was not there mentally and lacked restraint if he got upset (not to mention pit bull he had with him at the time.) He's well known in the area.
