Are Bolt-Ons a tax right off for SPs?

I saw a couple clips recently about dancers with HUGE implants and claiming they were a tax right off.

I'm wondering, "assuming" an SP reports her income or at least part of it. Can she right off implants for a tax right off?

...And/or Can she right off other work stuff like condoms, shoes, lingerie. I assume advertising is a business expense.

Just curious.
Though lets, forget the arguements that SPs don't pay taxes I'm sure at least a few do.

So I guess travel is in there too. If you can write off crotchless panties, then could write off plane tickets, cars, gas.

Hell a smart girl, yet, bad girl could even make a few dollars.

About the hotel rooms thing, could use the excuse that it was a prep area to get ready to meet a client or something like that.(just an off the cuff idea.) Lots business people will get a hotel room in the same hotel as a conference/meeting to take care of last minute notes/calls/pre meeting etc etc.

Not that I am an expert, but if an SP tried to claim her breast enlargement, I suspect the tax folk would insist that it be prorated as an item used only partly for business purposes and also used for personal purposes (where it might qualify as a deductable medical expense) like a car. It's up to the self-employed taxpayer to prove what percentage of the use was business, and what personal, and prorate the costs she wants to deduct accordingly.

Since lounge singers' formal wear is considered not to be a theatrical costume, but merely personal wear repurposed as a costume, available for ordinary non-business use and therefore not a business expense, I'd suspect she'd be lucky to talk the CRA into even the car version of the exercise.

Just throwing forward what I heard from a friend - she got her boobs with a medical expense receipt, with no reference as to what the expense was. She claimed she used it on her taxes as a medical expense. I'd hate to get audited on that, but its what I've heard.

PS. Yes, smart SPs are paying taxes. Without doing so you can't contribute to your RRSP, own property, get a mortgage or loan, and its awfully hard to reintegrate into the 'real' world once your pro-ho career is over. Its incredibly important: CRA doesn't care where your money is coming from, they just care they get their share, and as SPs need at minimum regular healthcare it only seems fair...

Suddenly I wish I was a tax auditor. I would need to see the aforementioned "questionable expense" up close and in action before making my ruling...

I'm pretty sure we can write off condoms but I've never tried - don't usually keep those receipts. I doubt a non-sp could do so though in the scenario you describe.

JFK beat me to this. Serious questions in this area should absolutely be refered to someone who is a specialist in this field. The rules are complex and full of contradictions.

I believe, based on established tax case law, CRA can and wants to tax any net business income regardless of whether or not the business activity is legal or not. Consequently, even if the activity is illegal, any expenses incurred to earn that business income should be deductible. Technically, even a mobster is required to report business income (eg. from extortion, smuggling, etc.) and is able to claim expenses incurred to generate that income (eg. hit man fees, bribes, etc.). Remember, Al Capone was put in jail for tax evasion.

For SPs, they are technically required to report their income from their SP business activities. They should be entitled to claim expenses they incurred to earn that business income like condoms, hotel rooms, etc. As for bolt ons, since they have a usable life of more than one year, they probably cannot be claimed as an upfront expense but can be claimed over a number of years as a depreciation expense. Boobs do depreciate!

No, she can't claim them as a tax right off.
However, she may be able to claim them as a tax write off.

Sorry to be so anal about it, but . . . seriously. Those two are nothing alike.

I am desperately trying to think of a scenario in which an SP1 who claims $10K income yearly (non-taxable) is worse off than an SP2 who claims more than that and pays taxes.

Criminals are expected to pay tax on their earnings, therefore they should get the benefits of writing off any expenses incurred.
Go ahead, write off your hotel or a portion of your home if you're operating a bawdy house.

The rules are always changing, after a long battle bike couriers are now allowed to write off the food they consume on the job because it's fuel for their vehicle.

I've done tax returns for SP's and dancers before and claimed cosmetic surgury, clothing, rooms, etc as deductions on the statement of business expenses. I would not claim cosmetics (even pre-budget) as a medical expense. Of course, the person should keep all their receipts.
