A tough one. If the clerk gets a good lawyer and makes the case his state of mind was fear for his life...he may get off.
Victim did precipitate the actions though that led to his death - unprovoked physical attack on the clerk. I wonder how his woman feels. Did she just say the clerk was mean, and the guy took it upon himself to go at clerk,, or did she send him in to teach clerk a lesson?
