LONDON, ONT -- A Kitchener judge has ruled that sections of Canada's prostitution law violates the constitution in a landmark case surrounding a London couple.

The case, which was moved to Kitchener last April, surrounded Tiffany Harvey and Hamad Anwar who ran an escort agency in London.

The couple was charged in 2015 when police raided Fantasy World Escorts.

While several human trafficking charges were dropped they remained charged with advertising sexual services, making money from the sex trade, and procuring for the sex trade.

Those charges have now been stayed as Justice Thomas McKay ruled that they were unconstitutional, a decision that is likely to be appealed by the Crown.

"Legislation for which the stated purposes include eliminating exploitation and reducing the risk of violence to sex workers actually has the effect of exposing sex workers to an increased risk of exploitation...," said McKay in his decision.

McKay noted that his decision is in regards to this case only. This means that the case will serve as a test case for higher court cases.

The couple challenged the charges saying they violate a sex worker’s right to a safe work environment.

The couple's lawyer James Lockyear spoke with media praising McKay's decision.

"I think his judgement is a tremendous advance for the cause of a good society, and a society that protects those who are being exploited especially the sex workers," said Lockyear.

The constitutional challenge was the first of its kind against Canada’s new prostitution laws brought in back in 2014 under the Harper government.

The Crown argued that sex work cannot be made safe and says the legislation is constitutional.

Legal analysts say that today’s decision will likely be appealed and could end up in the Supreme Court of Canada.

I was wondering why all this talk of trafficking in the media as of late. The conflating is through the roof with supposedly Peel having the most cases of trafficking.

This is definitely headed to the Court of Appeal and - unless Justin folds his hand and redrafts a better law - up to the Supreme Court.

In Bedford , the Ontario Court of Appeal supported the trial judge and I think that's what will happen with this as well.

In the meantime, the police will back off laying charges.

The john provision is now challenge-able as well, in the wake of this decision.

There is an MP owner (Yanik Chicoine, owner of La Montrealaise) in Quebec who is daring the police to charge him so he could take his case to court. (I saw "McKay" and thought for a moment it was Peter.)

This will definitely help combat trafficking by allowing girls a legit business and hobbyists legit options so they don’t need to rely on the shady black market. Similar to cannabis where people were forced to deal with drug dealers and who knows what kind of dirty impure unregulated cannabis.

This is a huge step toward eliminating corruption sparked by the government’s decision to violate fundamental human rights to choose what they want to do with their bodies as adults.

Personally, I have seen a downturn in the hobby since C-36. Along with other event like CragList shutting restricting their adult oriented ads. The hobby has not been as robust as it has previously been. Is it just me have things actually gone down.

Various levels of government are heavily advertising anti-sex trafficking at the moment because it makes sounds like they're addressing what most people would call a problem. It's part of laying the ground work supporting the Crown lawyers and political parties (all of a Conservative bent) efforts against prostitution. Let's be real and understand that supporting Conservative policies will reinforce current anti-prostitution laws and eventually try to lock it down entirely, just like other parts of their platforms like anti-abortion and other social controls on society.

Question: Now, with this decision, we have a situation where virtually everything is legal regarding the selling of sex, and its functioning as a legitimate business, with the exception of purchasing - which remains illegal. Does this mean LE will still be enforcing the law against buyers for the foreseeable future?? The premise of the law is idiotic. Try substituting sex with any other consumer good or service and you’ll see what I mean. Is there a way to incorporate the buying provision into this challenge, or must it remain separate? I’m sure it will embolden others that challenge the buying provision regardless, but that could take upwards of 10+ years. Further - just playing devils advocate here, but assuming Peter Mackay is PM during such a challenge, could not his remedy be to make buying and selling sex illegal? Then what will we do??

I got a lot of shit back during election season for saying this, but I’m going to say it again: if you’re on this site, you’re presumably a hobbyist, in which case if you vote conservative you are voting against your own interests. I know politics are a team sport now and we automatically have to hate the other side, but Peter Mackay is very possibly the next conservative candidate and happens to be one of the main players in drafting C-36. We have an opportunity now. Singh has publicly stated that he supports decriminalization, Trudeau has characteristically flip-flopped and been both for and against decriminalization, depending upon when he was asked and who was asking. A Trudeau-Singh coalition like we have now is probably the best case scenario for getting decriminalization. I know us lefties are a bunch of snowflakes, but for once, it might actually be better to think with your dick...
