KITCHENER — A Kitchener judge needs at least three more months to decide whether parts of Canada's prostitution law are unconstitutional.

A ruling had been expected this week.

"The decision is not ready yet," Justice Thomas McKay said in court on Thursday. "I'm certainly working away at it, but more time is required."


The ruling is now expected on Feb. 21.

McKay has before him thousands of pages of reports, testimony from several experts and case law.

It's legal for someone to sell their own sexual services, but it's illegal to advertise someone else's sexual services or earn money off a prostitute,

Lawyers for the owners of Fantasy World Escorts — who were charged in 2015 and are on trial — previously argued in court that the prostitution law endangers sex workers by making it illegal for third parties to hire them. Working indoors is safer than working on the streets, they said.

Hamad Anwar, 30, and Tiffany Harvey, 28, are charged with benefiting from the sale of someone else's sexual services. Anwar is also charged with procuring and advertising someone else's sexual services. Fantasy World Escorts advertised on bus shelters in London, Ont.

A prosecutor in the case previously said prostitutes can use online safety tools such as "bad date" websites to protect themselves.

The Kitchener case is the first time a court has examined whether portions of the law are constitutional. A ruling against the prostitution law would apply only to this case.
