Trump, Democrats offer duelling arguments ahead of Senate impeachment trial

Impeachment a 'brazen attempt' to overturn 2016 election, says Trump's legal team

Thomson Reuters·Posted: Jan 18, 2020 5:50 PM ET | Last Updated: January 18

The Democratic lawmakers leading the impeachment case against U.S President Donald Trump said on Saturday the Republican president must be removed from office to protect national security and preserve the country's system of government.

In a brief, the lawmakers laid out their arguments supporting charges of abuse of power and obstruction of Congress against the president.

"The Senate should convict and remove President Trump to avoid serious and long-term damage to our democratic values and the nation's security," the lawmakers said, for the first time formally calling for the Senate to convict the president and remove him from office.

"The case against the president of the United States is simple, the facts are indisputable, and the evidence is overwhelming," they said.

Trump's legal team issued a resounding rejection of the House of Representatives' impeachment, calling the charges against Trump an attempt to overturn the 2016 election.

"This is a brazen and unlawful attempt to overturn the results of the 2016 election and interfere with the 2020 election — now just months away," Trump's lawyers argued in a six-page document released on Saturday.

It was the first time Trump had formally addressed the merits of the two articles of impeachment — abuse of power and obstruction of Congress — that the Democratic-led House approved late last year.

The two articles, aimed at ousting Trump from office, form the basis of a trial that will begin in earnest on Tuesday in the Republican-controlled Senate.

Trump, at his Mar-a-Lago club in Palm Beach, Fla., for the weekend, played a round of golf on Saturday.

Trump is accused of abuse of office for pressuring Ukraine to investigate a political rival, former vice-president Joe Biden, and of obstructing Congress in its investigation into his conduct.

"An acquittal would also provide license to President Trump and his successors to use taxpayer dollars for personal political ends," the Democratic lawmakers' brief said.

Trump has denied wrongdoing and has accused Democrats of a partisan-driven effort to undo his 2016 election victory.

The Senate trial is unlikely to lead to Trump's ouster, as no Republican senators have voiced support for doing so.

That is why they are known as Banana Republicans. They want the President to rule like it is a Banana Republic, that conducts Kangaroo Courts.

The right wingers will be in denial of the facts between the Clinton Trial and what is occurring currently. That is why has tainted the characters / professionalism of Moscow Mitch McConnell, Ken Starr and Alan Dershowitz.

You should be ashamed of yourself for posting this purest form of bullshit. Clinton invoked the Executive Privilege to keep the witnesses from testifying. It was properly challenged in court and overturned. What did Schiff do? Instead of following the legal and proper route, he simply charged the President with the obstruction of Congress!!!!!!

Anyone in a democratic country such as Canada, the U.S. or elsewhere is always best to refer to specifics and not get too deep into the generalizations.

The Documents were readily available at that time and used against Clinton. Remember that the Clinton investigation was about the Whitewater scandal that had nothing to do with his sexual allegations. Ken Starr used it to impeach him and had access to one of the first hand witnesses that broke the story to him. Lewinsky the main witness testified behind closed doors. Nothing "bullshit" about it, as the court cases etc. would have taken months in Trump's Obstruction of Justice case. The Trump team were prepared to take it to the Supreme Court, just to delay it. Are the Republican Senators willing to allow the witnesses to testify in spite of 70% of the Americans being in favour of it?? Definitely not unless there are four Senators that switch to support it. Not just Obstruction of Congress as that is just one of the two articles. Abuse of Power is the second article!!!!!

When 70% of the Americans want witnesses to testify and there is one first hand very willing witness called John Bolton, those are the specifics. You better let the right wingers know that they should not "generalize"!!

Oh, so the timing was the problem, eh? It was faster and more convenient to just charge the accused without bothering about his rights, eh? Who gives a fuck about the due process? Btw, that's how real abuse of power looks like- in case if you're wondering.

Absolutely was, a problem. There was enough of evidence to charge him, and he used his powers to even prevent the documentary evidence from being handed over to the Congress. But we subsequently have seen them, and it corroborates the evidence that was given by the witnesses who testified. Even those witnesses were blocked form providing their own email documents. Yes, Trump gives a F**K about Justice as he thinks that he is above the law. Abuse of Power......that is why he was Charged with it, so nothing to "wonder" about!!

LOL! Evidence for what? The quid pro quo? Oh, sorry they didn't charge him with that. Bribery? Nah. How about the crimes revealed by the "whistleblower"- the whole reason for this investigation? No, not that either.

Abuse of power!! Getting a foreign nation to announce an opening of the investigation into the Bidens, so that it will help Trump in the 2020 elections. Otherwise, they will withhold the funds approved by Congress. What was Trump's excuse for holding it and only releasing it once the Whistle blower blew the whistle on him?? Can you get a straight answer from Trump, as he is in sixes and sevens with his excuse for doing so?
Yet no mention of "Corruption" in the phone call as he claimed that he was doing even in the summary of his call that he released. But continue to live in denial, as the No Quid Pro Quo stuff was harped by Trump from day 1. So, if there are no wrongdoings, then Trump should allow all his staff to testify and that will fully exonerate him. Yes / No, otherwise what is the problem?? Wonder why even Bolton called it a drug deal!!

It never happened according to the transcript nor did Ukraine announce such investigation. Of course the Ukrainian president is on record flatly denying it, too.

It happened, Trump withheld aid and Ukraine was just about to announce an investigation when the whistleblower came forward.
After that it all fell apart.

Attempted murder is a crime just like murder, as is attempted bribery.

There's nothing illegal about withholding aid, the announcement was never made and the Democrats prevented the "whistleblower" from testifying.

Withholding aid was illegal, it was just reported.
Just because Trump is inept and got caught in the act doesn't me he didn't do it.

The GAO concluded that Trump broke the Law. Trump was pissed off that Ukraine did not publicly announce it as all the emails / text messages have corroborated that statement. Again, Trump only released the aid after it was clear that the whistleblower broke the story. That transcript did not mention "corruption" in the phone call. Why are the full transcripts not being released??

Don't be silly. Of course most defendants prevent witnesses who have exculpatory evidence from testifying. The call was perfect so of course he doesn't want any witnesses to tell anyone how perfect it was.

It's interesting that Trump's defense believes the transcript to be his ultimate defense. The Democrats also think the transcript is a part of their case against the President.

The difference might lie on how fairly one believes the Democrats are using their imagination to extrapolate beyond the details of the phone call. In my opinion, we do not convict anyone no less a President on extrapolating evidence.

Ever since Schiff refused to use the "whistleblower" it was clear that the transcript was the silver bullet. Just another Julie Swetnick. The only difference is that, unlike the Kavanaugh circus, this time, the Democrats had the votes.
