Shouldn't you find a Canadian incident to ask about? Each country — and every American state — has entirely different laws about what is or is not a crime, and your Ria Cooper's complaint was filed in Britain, under English laws.

Not to mention anyone who wants to comment will have tough time figuring out who 'offered' sex to whom, and whether any backing out was the offer withdrawn, or the offer turned down.

And who cares, if you weren't one of the two people involved? Or the English police in Hull?

This is a tale of two rights.

The right to purchase without discrimination and the right to govern ones body.

IF the laws allowed for the purchase of sex (which they don't) this would be a matter of competing rights and no judge in the world is going to tell a person they are legally obligated to have sex with someone. The right to governs one body would win.

So;

1. No it is not the same as you are not legally allowed to purchase sex
2. It is only bad if you have issue with it. Most women will not as it is their body. Most men would because they are the ones being declined.

On the topic of transgender, again it is competing rights. The right of the trans person to be able to live their authentic life and the right of a person to choose whom they want to have sex with. That includes the right to choose to only have sex with CIS gendered people or those who are fully transitioned. It is laughable to call it a hate crime for being refused sex.

First off, refusing to have sex isn't a crime, so it couldn't even BE a hate crime. So that's the article dealt with.

It gets a little muddier when it's for paid companionship, because technically you can't deny service on the basis of gender. But then...the purchase of sex is illegal, so the best you could argue is that the person owes you "companionship", which is loosely defined and could be easily satisfied without engaging in sex. Plus, no judge in their right mind would force someone to have unwilling sex just to satisfy that section of the Human Rights Code. Other, fundamental rights would supersede it.

We’ve been over all this with the Jonathan/Jessica Yaniv case. It is not a human right to have your genitals touched, and you cannot legally compel someone to do so. The courts have spoken, the precedent is set. You have the right to decline to touch someone’s genitals if you do not feel comfortable doing so for any reason. A bit crazy that we needed a human rights tribunal case to literally put that in writing, but here we are.
