    if you rescind the offer to have sex, is that a hate crime?

    Finding out that your provider or client is transgender is like finding out they're black and backing out of an offer to have sex, may be a legal hate crime.

    Ria Cooper has transitioned between being a man and women (3 times). His penis is intact. He filed a hate crime report with the police who are investigating (?) after a man rescinded his offer to have sex (no payment).

    He says, "It's like being called the N word".

    1. Is this the same as all of the adds that make it clear if you're black, don't bother trying to pay for an SW?
    2. Is it not as bad?

    Shouldn't you find a Canadian incident to ask about? Each country — and every American state — has entirely different laws about what is or is not a crime, and your Ria Cooper's complaint was filed in Britain, under English laws.

    Not to mention anyone who wants to comment will have tough time figuring out who 'offered' sex to whom, and whether any backing out was the offer withdrawn, or the offer turned down.

    And who cares, if you weren't one of the two people involved? Or the English police in Hull?

    And all that's before we even consider the specious comparison to sex-work.

    This is a tale of two rights.

    The right to purchase without discrimination and the right to govern ones body.

    IF the laws allowed for the purchase of sex (which they don't) this would be a matter of competing rights and no judge in the world is going to tell a person they are legally obligated to have sex with someone. The right to governs one body would win.

    So;

    1. No it is not the same as you are not legally allowed to purchase sex
    2. It is only bad if you have issue with it. Most women will not as it is their body. Most men would because they are the ones being declined.

    I did not read the article as it was clear you changed the context for the industry.

    On the topic of transgender, again it is competing rights. The right of the trans person to be able to live their authentic life and the right of a person to choose whom they want to have sex with. That includes the right to choose to only have sex with CIS gendered people or those who are fully transitioned. It is laughable to call it a hate crime for being refused sex.

    First off, refusing to have sex isn't a crime, so it couldn't even BE a hate crime. So that's the article dealt with.

    It gets a little muddier when it's for paid companionship, because technically you can't deny service on the basis of gender. But then...the purchase of sex is illegal, so the best you could argue is that the person owes you "companionship", which is loosely defined and could be easily satisfied without engaging in sex. Plus, no judge in their right mind would force someone to have unwilling sex just to satisfy that section of the Human Rights Code. Other, fundamental rights would supersede it.

    I see no-one wants to take on the "black dudes not welcome" issue.

    I'm not black, but I have a terrible problem when I see a SW advertise that.

    BTW "My body, my right" doesn't cut it. We're not talking about danger, or poor work conditions. YMMV is rampant in this industry, not for race issues, but for anything. I can't imagine why someones race is doesn't fall into that category. Make the appointment with the black guy, if he's too "something", do what you do all other cases, no DFK, no CIM, etc. offer this other thing and refuse whatever particular service is effected.

    Think any other service provider, dentist, plumber, or even gynaecologist.

    What is wrong with discrimination against potential business?
    Every one should have the right to say no, it is kinda the point in working for yourself - to maximize freedom.

    The market will do it's part if need be.
    That is the benefit and purpose of the review boards.

    Some providers do not want to be YMMV, they prefer what they prefer and no one has the right to tell anyone who they must fuck or suck, regardless if there is money involved or not.

    Do you also oppose higher car insurance premiums for younger men? Same logic.
    And in the case of SPs, we actually are talking about security of person. You're going to be alone with a stranger in a private setting, engaging in intimate activities.

    We’ve been over all this with the Jonathan/Jessica Yaniv case. It is not a human right to have your genitals touched, and you cannot legally compel someone to do so. The courts have spoken, the precedent is set. You have the right to decline to touch someone’s genitals if you do not feel comfortable doing so for any reason. A bit crazy that we needed a human rights tribunal case to literally put that in writing, but here we are.

    black men are the only ones told my body my choice .Black men are the only ones told who they can or cannot date and sleep with. And interracial dating is only condemned if black men does it. This is probably the reason why you never see black incels. Black men are used to get rejection everywhere.

    August Ames killed herself because she posted that she doesn’t work with guys who do gay or trans porn for safety reasons and got attacked relentlessly by the twitter mob for it. She was quite reasonable, she explained that she felt the testing process wasn’t as rigorous as in hetero porn (don’t know if that’s true or not, but that was her opinion), and that she wasn’t homophobic, it was entirely a health and safety issue for her. These people don’t care about reason. It’s about emotion and ideology, and it’s fucking bullshit. These people are thugs and bullies and more people need to stand up to them and call them out on their shitty behavior.

    And at least 2 porn stars that bullied her openly refused to perform with black men. And one blocked me on twitter when I ask him if it is racist to refuse to perform with black men.

    It's year 2019 and if a client couldn't accept the fact that not all women have vaginas, then the onus is 100% on you. Yes there should be descriptions like an SP's race and cis/trans status, but it should be your responsibility to read them. If you go in and EXPECTED her to be cis but she's trans then, well, tough shit.
