Jack Phillips faces third lawsuit over refusal to make gender transition cake

Christian baker Jack Phillips of Colorado is facing a third lawsuit over his refusal on religious grounds to make certain cakes, the latest legal battle for the Masterpiece Cakeshop owner.

Transgender woman Autumn Scardina filed a second lawsuit against Phillips last Wednesday in District Court for the city and county of Denver, Colorado.

In the new lawsuit, Scardina claimed that Phillips violated Colorado’s Anti-Discrimination Act and Consumer Protection Act by refusing to bake what the plaintiff labeled a “birthday cake.”

The “birthday cake” as described in the lawsuit, which was to be blue on the outside and pink on the inside, was supposed to symbolize Scardina’s transition from male to female.

Scardina is being represented by attorneys Paula Greisen and John McHugh. In an interview with local outlet CBS 4, Greisen said that the “dignity of all citizens in our state needs to be honored.”

“Masterpiece Cakeshop said before the Supreme Court they would serve any baked good to members of the LGBTQ community. It was just the religious significance of it being a wedding cake,” claimed Greisen. “We don’t believe they’ve been honest with the public.”

Jim Campbell, senior counsel with the Alliance Defending Freedom, which has represented Phillips in his past litigation, said in a statement that was mere harassment.

“A new lawsuit has been filed against Masterpiece Cakeshop that appears to largely rehash old claims. The State of Colorado abandoned similar ones just a few months ago,” stated Campbell, as reported by CBS.

“So this latest attack by Scardina looks like yet another desperate attempt to harass cake artist Jack Phillips. And it stumbles over the one detail that matters most: Jack serves everyone; he just cannot express all messages through his custom cakes.”

Over the past few years, Phillips and his Masterpiece Cakeshop have been the subject of litigation aimed at forcing the baker to provide services for events that he is opposed to for religious reasons.

Last year, the United States Supreme Court ruled 7-2 in Masterpiece Cakeshop v. Colorado Civil Rights Commission that Colorado’s Civil Rights Commission was wrong to punish Phillips for refusing to make a same-sex wedding cake.

The Supreme Court ruled that the Commission violated Phillips' right to free exercise of religion due to the bias showed in their application of civil rights law.

“To describe a man's faith as 'one of the most despicable pieces of rhetoric that people can use' is to disparage his religion in at least two distinct ways: by describing it as despicable, and also by characterizing it as merely rhetorical—something insubstantial and even insincere,” wrote Justice Anthony Kennedy for the majority.

“This sentiment is inappropriate for a Commission charged with the solemn responsibility of fair and neutral enforcement of Colorado's anti-discrimination law—a law that protects discrimination on the basis of religion as well as sexual orientation.”

Soon after, Scardina filed a complaint with the Commission against Phillips over his refusal to make a cake celebrating Scarinda’s gender transition. In response, Phillips sued Colorado last August.

In March, Colorado and Phillips both agreed to drop their respective litigation, with Colorado Attorney General Phil Weiser stating that “both sides agreed it was not in anyone’s best interest to move forward with these cases.”

“The larger constitutional issues might well be decided down the road, but these cases will not be the vehicle for resolving them,” said Weiser earlier this year.

“Equal justice for all will continue to be a core value that we will uphold as we enforce our state’s and nation’s civil rights laws.”

The third lawsuit is allowed because the agreement between Colorado and Phillips provided Scardina the right to pursue separate litigation against the Christian baker.

For fuck sakes, if they know the guy doesn't want to make the cakes, it is just selfish grandstanding to keep going back and making him refuse them. All so they can sue and make the guy's life hell, all because they disagree with his religious beliefs. Scardina should be prosecuted for harassment. Surely there are other bakers that would gladly make his cake.

Bullshit. Not even close. Anyone can buy a cake from this place as long as it does not conflict with his beliefs. Anyone, period. He does not ban anyone from being a customer. He does restrict what they can order and that restriction applies to everyone equally. If a straight person tried to order that same cake they would be denied.

Not quite, as his lawyer says, "Jack serves everyone; he just cannot express all messages through his custom cakes". As you say, he would deny a straight person a cake for a gay wedding.

The issue is whether his business can legitimately 'censor' because of his own beliefs, the legitimate expressions its customers want on the products they purchase. Is he a public business selling custom cakes? Or is he a cake-missionary pushing his personal religious belief?

Given the earlier publicity, it seems obvious that this latest case has really has nothing to do with cakes, transitioning or birthdays. it's all about one Warrior for Truth, Justice, and The American Way going up against another Warrior for Truth, Justice, and The American Way. Because that American Way is about Winning, it's about Black OR White, not about people just getting along.

Least of all about cakes.

It's the convoluted nature of the Left's hypersensitivity. Muslims are a protected class. As long as you hold anti-Western and anti-Capitalist ideals, you will be afforded special protection by the Left. Muslims often come into conflict with other protected groups including feminists and homosexuals. When these groups come into conflict with each other, it gets confusing for the Left. It's just like some feminists coming out against transgender athletes competing in women's sports. Ahhhh, my head hurts!!!!

As far as the righteous Colorado baker, just make the fuckin' cake. This whole thing does have similarities to white only lunch counters. People can find all sorts of religion to defend their beliefs (and hatred). Unfortunately for them, when you want to sell your goods or services in the Western public square you have to treat everyone equally and check your ideologically at the front door of your business.

I totally didn't rank that higher than actual racism against minorities. These days the targeted groups are Muslims, not Jews and not coloured, just Muslims. In the way that in the 1920's you could walk around the US in your white hood and clansman attire and yell the 'n' word while blaming them for all the ills of society. Since you're not allowed to do that to Jews or any other minority any more, you're left blaming Muslims for all the problems in the world. Must be harder for you, though I expect when the world calls you out on Islamaphobia it'll just have to get all bottled up again.

It's not selfish grandstanding. They can't win in court, but they can bully their targets with lawsuits. They're hopping that the threat of financial hardship or even downright ruin will force others to capitulate. Progressives are a bunch of fucking fascists.

I think you have projected a lot on to my comment. I have no problem calling out Christians, Muslims and any other religious group for what I deem intolerance. You might have noticed my next comment chastised the Christian baker.

It's just my personal belief that some religious beliefs cause people to further divide.

Perhaps I was too nuanced in my post. Without too much elaboration, the Left has difficulty balancing Women's Rights and Islam. Women in many Islamic governments do not have the same rights as women in Western countries.

Perhaps, but then you need to tell us whether that's because of repressive governments or cultural norms?
'Cuz in my experience, I haven't seen any such issues with either the women or Muslims I know.
And the second generation Muslims are very much Canadian in their values.
Of course there are secular and non-secular Muslims just as there are for Christians and other faiths as well.

For exactly the same irrational reasons he won't make a pink cake with blue icing. Not quite the same as a men's barber refusing to cut a woman's hair.

The cultural norms argument is frequently thrown around. The Left tries to pass off this issue by saying this is how these women choose to live. In fact though, many of the rights afforded Muslim men and deprived of Muslim women in certain countries are codified into law.

I'm sorry but generally I find the cultural norm argument a red herring. You can hear Southern whites seventy years ago saying that Jim Crow laws were a part of their culture. The races needed to be separate.

There are certain values that transcend race, creed, gender and borders and we shouldn't be ashamed to advocate and defend them.

There was a poll in Canada that came out and showed that Canadian Muslim women who wore the hijab did it out of choice.

Like everything else that humans generally do, cultural norms are never fixed, always changing. We make laws that codify the norms, to slow the process or accelerate it, but they only sorta work. And we advocate and defend some to the point of warfare, much more often than is good for anyone. But they change too, just more slowly.

I lived through a period in Quebec when the province transform itself from a religious to a secular society. I would recommend Muslims do the same.

As with Québecois, most Canadian Muslims are becoming more secular. As with Québecois, not all. Likewise with tolerance.

People are individuals, they change at their own pace. Sticking some uniform label on them doesn't make them, march as one.
