Not sure about pornstars, but congressmen and other politicians regularly pay off claims of sexual harrassment.

The biggest issue here was Trump and Cohen's intent to hide the payments, which showed that they knew that the payments were illegal.
Sanders and Obama just made errors and unwittingly took in donations they shouldn't have.

If Trump did it all out in the open and then got told it was wrong he would be given a fine, but because he hid it that shows that he knew it was wrong.

It was Cohen's personal cheque that was made out to Stormy. You have to prove Trump knew about the payment. Of course he probably did, but the onus is on the FBI to prove that he did, which is very difficult

Also, that looks like a personal cheque, so that voids the theory that Trump used campaign funds to pay her off

The courts already looked that those cases.

And they usually just issue a large fine, they never seek jailtime for politicians who break the rules (whether knowingly or unknowingly)

Trump the candidate is ultimately responsible for everything his official campaign does. Like a worthy captain, he can own up, or like a coward he can say, "He did it, and"I knew nothing". Which only makes him not competent.
