His selfish negligence killed someone, entirely predictably. Nor was this just a single moment of inattention; he was texting back and forth continuously for almost half an hour. If you believe in the deterrent value of sentencing, it should have been longer.

My brother was stabbed 28 times in the chest. They ruled it manslaughter. Sentence was 5 years. He was out in 2.5 years.

Agreed, he wasn't sentenced for texting, he was sentenced for killing and injuring people he should have gone for life.

I don't consider a four year sentence harsh based on the evidence. Interesting there's no mention of a driving ban. Hope he isn't permitted to drive for a minimum of 10 years after he's released.

As if that has worked to deter the deliberate killers or the unintended ones. That's why I included: "If you believe in the deterrent value of sentencing,". Personally, I don't much believe in it, and the little I know about sentencing practices suggests that 4-6 years is not uncommon for manslaughter, as indicated in Big Sleazy's sad post about his brother's tragic death. It is sad reality that no sentence can ever heal the pain of a loss like that.

Judges not only hear all the evidence and arguments, but they also take a good long time to consider the sentences they decide. And they take great pains to explain and justify their determination. I have never had much patience for folks who pretend they can come up with a better sentence over coffee, or a beer.

I don't agree with a judge basing her sentencing off the idea of "sending a message", but I believe the sentence in this case fits the crime regardless, given the outcome.

I'm addicted to Advil Liquid Gels. I wake up with a headache every morning and I can't sleep beyond 4 hours. I got my latest MRI results on my head yesterday, it's not good. The neurologist bumped up my appointment from May to the end of this month. It's almost certain that I won't see 70.

All because an asshole wouldn't stop texting while driving. He should have gotten at least 10 years with no time served.

The only thing worse than losing a loved one is when you lose them unexpectedly, and the only thing that's worse than that is when we lose a loved one unexpectedly in a violent murderous way. I can't imagine.

The system let you and your brother down. Horrible. My sincere condolences.

Not negligence (they claim using the phone made it negligent which is utter nonsense)
When you break the law it becomes negligence. Guy crossed into the oncoming car's path because he was paying attention to his phone and not his driving. He got off lightly, he should have gotten the maximum 10 years.

Now, try to convince us texting while driving is not breaking the law. I can't wait to hear this "logic".
