4 years for texting while driving is absurd, next thing you know they will start throwing people in jail and calling them terrorists for the simple act of performing street chemistry.

IF he'd been paying 100% attentio0n to his driving, and there was no way he could avoid an entirely unexpected, sudden danger, that might be an accident. Or it might be the fault6 of another negligent driver. A toilet falling out of an airplane and hitting the car could be an accident. Most vehicle-vehicle collisions are driver-caused crashes, not 'accidents' at all.

This driver had been neglecting his driving for the better part of the previous half-hour. He was getting texts, reading them, then replying almost immediately, then getting a reply to that and starting the cycle again almost without stopping. All that was in his phone memory and was part of the evidence in court.

Negligent is the mildest term that applies.

It is against the law to use a phone (non-hands free) while driving. The judge found the evidence supported the guy using his phone led to the accident. A person died because of the accident.

Textbook case of criminal negligence causing death which according to google is up to 10 years.

Reasonably prudent people are guided by the law. If there is a specific crime defined, then we don't need to charge that lawbreaker with the blanket offence of negligence, that is "failure to exercise the care that a reasonably prudent person would exercise in like circumstances". They were indeed wilfully neglectful of the law and of the specific behaviour it defines as criminal, just as slurp said, but as you point out, that would be useless over-charging, and we — being reasonable people — try not to do that.

No argument here, folks. Please, just keep moving along.

Personally I condemn those who criticize others for unnamed and unknown things they do themselves. Routinely, or only on special occasions, fast or slow,it makes no difference.

Yes but harping on the fact it's illegal to make ones point coming from folks who break the law everytime they see a lady is hypocritical and I'm not condoning texting and driving by any means. I will add though, majority can't resist doing so and the younger the driver the more chances they are doing so.

It sounds like some people don't know how to take responsibility of their actions. In this case, the man texted while driving and killed an innocent man because his eyes and mind were on the cellphone and not the roads. I think the 4 years of prison is too little. It should be at least 10 years in jail for killing another innocent person from his action of texting while driving.
