Washington Senate passes bill that would keep Trump off 2020 ballot unless he releases tax returns

Washington's state Senate passed a bill this week that would drop President Trump from the state's 2020 presidential ballot until he releases his tax returns.

The bill, which advanced Tuesday to the state's House of Representatives, according to CBS News, would require any candidate on the ballot for president in the state to release five years of tax returns before appearing in a general or primary election.

Senators voted by a 28-21 margin to approve the bill, according to CBS. The state's attorney general and solicitor told lawmakers in a letter this week that the proposal likely was constitutional, but analysts expect the law if passed to be challenged in federal court.

"The disclosure requirement you propose is likely Constitutional," the two wrote to lawmakers, according to CBS, adding that the measure "would definitely be challenged in court."



Democrats who supported the bill said the provision was necessary to force a return to norms surrounding the release of presidential candidates' tax returns.

"Although releasing tax returns has been the norm for about the last 40 years in presidential elections, unfortunately we've seen that norm broken," said Sen. Patty Kuderer (D), who sponsored the bill, according to CBS.

Republicans, however, argued that the state was getting into questionable territory by attempting to impose rules on a federal election.



"We're on really risky ground when we're trying to place conditions on a federal election," said Sen. Hans Zeiger (R), according to CBS.

Trump caused controversy throughout the 2016 campaign with his refusal to release his tax returns, claiming at the time to be under audit by the IRS. In recent weeks, Democrats in the House have indicated that they may pursue Trump's returns in the hopes of investigating the president's finances for criminal activity.

A similar bill recently advanced in New Jersey's state Senate and is currently sitting in the state's General Assembly.

The Constitution already covers that. Anything beyond that will die in the Supreme Court.
I dunno. They put an age restriction on running for POTUS- ie over age 35. Why would this be different?

In my mind it's different as the first step on a potentially slippery slope. If tax returns are required then why not school transcripts? Medical records? Aptitude & intelligence tests? Personal correspondence? All things which (I believe) are not in the public record.

If I had my choice I'd like to see Trump's tax returns. However, they were not a requirement of him running for the office.

He challenged Obama to prove that he was born in the USA. Obama then stated that he would, but he requested that Trump release his Tax Returns. So Obama, did prove that he was born in the USA. But Trump lost the debate as he is shit scared to release his tax returns. Another Manafort kind of embezzlement by Trump that Mueller is probably investigating!!

In all seriousness, we go any distance down this road and the only people running for public office are the very young, who haven't had time to screw up, or those who haven't cut any corners, which is a nice way to say "unaccomplished".

As he lost the state it may well not matter.

Interestingly four Electoral votes defected to him. But he could in theory not be on that ballot and it wouldn't matter.

What are you doing wrong? Probably paying what you owe. It's only frauds and chats who do deals where they promise to pay, then pretend to have nothing and walk, when actually they're richer than before.

But your second sentence nicely outlines the danger of voting for just any successful rich guy and giving them the power to make the laws. The rich guy we're discussing has been a known shyster since the '70s. The various 'partners' who have taken his name off their developments have discovered to their cost, that he still is. Now the American people are learning the same lesson the same hard way.

How's that National Emergency working out for them? After shutting down the government because he can't persuade anyone to his thinking, like any honest leader? And never mind paying them, has he even settled his taxes yet? Or is he still refusing to be honest with the IRS?

In any case, to get back to the topic: Even though the Constitution says the states make the election laws, it also says the only requirement to run for President is to be at east 35 years old and born a citizen in the USA. Exactly how the Supremes would get a non-compliant candidate's name on the ballot if this becomes Washington State law remains to be seen, but most assuredly it would be there.
