Yeah, seems dumb to overturn it, rather than alter.

IMO, any fines should be tied to the person's income, so that the punishment has equal impact across all income levels. Though that's not without its problems either.

Did the "victim surcharge" actually go to the victim of crime? I'd always assumed it was doublespeak and went to general revenue.

I think the "victim surcharge" went into that bottomless pit call "general revenue".

However, I think the victim or his family can still sue in civil court. I think Marco Muzzo(sp) was sued in civil court-.

It would go to things like the Victim compensation board where a victim to apply for funds up to 25K.

Takes a lot to the get that amount but I'm pretty sure that is where the money goes first.

Any victim who sued in civil court is not eligible for money from the victims compensation board. Any victim who got money from the VCB and then went on to a civil lawsuit would have to pay that money back.
