Fox News’ Judge Napolitano: We Now Know Trump ‘Committed a Felony’

If you were watching Fox News when the Michael Cohen sentence came down, you would be pretty sure this was bad news for Donald Trump’s former fixer. Less clear was what it meant for the president himself.

For clarity on that, you would have had to wait a couple of hours until anchor Shepard Smith invited the reliably frank Judge Andrew Napolitano on his afternoon news hour to explain just how bad the day’s news was for Trump.

“We’ve learned that federal prosecutors here in New York City, not Bob Mueller and his team in Washington, D.C., career prosecutors here in New York City, have evidence that the president of the United States committed a felony by ordering and paying Michael Cohen to break the law,” the judicial analyst said. “How do we know that? They told that to a federal judge.”

“Under the rules, they can’t tell that to a federal judge unless they actually have that hardcore evidence,” he continued. “Under the rules, they can’t tell that to a federal judge unless they intend to do something with that evidence.”

Now those same federal prosecutors have entered into an agreement with AMI, the National Enquirer’s parent company, “which ties a bow on all of this,” Napolitano added, “which connects the dots between the payments to the two women who claim they had intimate relationships with the president, and the line running through all of that is the president himself.”

“Prosecutors have told us through these filings that they have evidence that the president committed a felony?” Smith asked his guest.

“The felony is paying Michael Cohen to commit a felony,” Napolitano concluded. “It’s pretty basic.”

As the instigator of the crimes that Cohen is now in jail for, its more likely he'll spend time behind bars then just get a fine.
It may be after he's impeached, resigned or if he lasts until re-election and fails then, but he'll get charged for these felonies.
Oh, and Cohen has him on tape.

On the tape, Cohen is heard saying that he needed to start a company “for the transfer of all of that info regarding our friend David,” a possible reference to David Pecker, Trump’s friend and president of AMI.


When Cohen began to discuss financing, Trump interrupted him and asked, “What financing?”

“We’ll have to pay,” Cohen responded.

What this shows is that Trump surrounds himself with crooks and has no qualms about breaking the law and lying to protect himself.
The Cohen crimes speak volumes about the kind of people Donald Trump surrounded himself with.

Indeed, Michael Cohen was not some random attorney retained by Trump to make election liabilities go away. Rather, he was the business mogul's long-time lawyer and fixer.
If you or I were attempting to carry out a crime, we would likely have a very hard time finding other people to join our effort. Most of us don't associate with crooks.

Apparently, not so with Trump. When faced with an embarrassing situation that might threaten his candidacy, all he had to do was turn to a close confidante in his orbit. Put simply, he had a go-to guy who could help him violate the law, if necessary, to deceive the American voters in an effort to attain the highest office in the land.

The reason this is so important is because there are larger legal issues looming for President Trump regarding his campaign's alleged ties to Russia and the integrity of those in his inner circle. We know Trump has closely associated with at least one criminal -- Michael Cohen -- so how are we to know there weren't other crooks in the candidate's midst?

We also know the President lied to the American people about his knowledge of the payment of hush money and the role of one of his top lieutenants in the affair. He has similarly denied any wrongdoing by his associates as it relates to the ongoing Russia collusion investigation. However, knowing he apparently colluded with Cohen to break the law and then lied about it, how are we to believe we are not being deceived about Russia as well? The President has simply exhausted all credibility.

Unless the rule of law has been suspended, it is pretty clear that if Trump directs Cohen to commit a crime, Trump is guilt of the same crime.

He admitted to it, but part of the plea was not to include that in the list of charges that he went to jail for.

Just because he did not do extra time for it does not change the circumstances. He committed a felony by paying the money. They could have easily given him jail time for it, but they didn't. trump paid him to commit a felony which is also a felony which also is very punishable by jail time. The fact that Cohen did not get extra time means NOTHING in regard to what trump could get. This is not difficult to understand and I'm pretty sure that you already figured it out on your own.

For a smart guy, you know how to play dumb when it is convenient.

Cohen lied to congress and the FBI about his and Trump's dealings with Russia during the election and since./
Cohen is now in jail.

We have yet to find out more about Trump's $50 million gift to Putin that was exposed through Cohen's cooperation with Mueller.

The whole point of the investigation was to determine if there was collusion between Trump and Russia. In 2 years we haven't seen anything beyond the circumstantial that this occurred in the slightest.
Even if Trump explicitly directed Cohen to pay hush money to the two women it is unclear if that is even a campaign finance violation. It was paid by Trump personally not out of his campaign fund.
Furthermore, there has to be required proof that Trump explicitly ordered the payments. Maybe that exists who knows? Judge Napolitano seems to think it does. That's his prerogative. He's been wrong before.
I guess time will tell.

Except for Cohen stating that he offered Putin a $50 million gift and Flynne discussing ending sanctions with Russia for deals.
Other then that, and Butina, and the 16 people who were in contact with the Russians and other then Trump calling for Hillary to be hacked in a speech and the Russians hacking her that night, other then that there has been hardly anything.
Oh, and don't forget the Trump tower meeting.

Mueller was tasked with investigating Russian interference. Once he started investigating, all roads led to trump.
